Picked up a 98/S Scooby at the w/e. 72k, FSH, very tidy, from an established (& recommended) small dealer. Took it for a light thrashing and 10ish miles later it started making a god awful clatter. Upshot is probably the big end.
So, do I ask for my money back or let them fix it. They have muttered about a new engine, which would be nice, but is a rebuild worth it?
All in all I am a tad peeved.

Take it back - bin it. Get your cash back and find another...
Quote the good old sale of goods act at them.
A product must be of merchantable quality and be fit for the purpose ..etc..etc...
Legally I think they're on a sticky wicket if they refuse a refund.
Check with your local CSB if in doubt.

bill, is it under finance? I had a similar problem buying a pug 106 for my son, it went pop after 5 days (big ends) the dealer said they would pay up to the cover limit (£300) I got in touch with the finance company (I think you have to keep them informed as a point of law)and told them I had no intention of paying anything whatsoever. They took care of everything.
Not financed - got it on the mortgage, so its not real money! Unless the housing market crashes.
The dealers want to have a look inside, to check what the actual problem is. I'v not told them I want a refund yet, as the CAB are busy and I'm checking exactly where I stand.
Glad i didn't sell my old car.

Quick update (Thanks for the advice btw chaps)
It was the big end, they are putting in an engine from a breakers. The CAB were very nice but not hugely useful - 1)Appointments only 3 days a week, for 3 hours. 2)You can't book an appointment, cos they're too busy to answer the phone. Repeat ad nauseam. When I did finally collar someone they told me what I knew from the website and then advised me to talk to Trading Standards.
TS were very helpful: (as mentioned by plipton) quote the Sale of Goods Act 1979 (as amended) in a letter stating that you are exercising your rights to reject the vehicle as it is not of satisfactory quality with respect to its mechanical durability, and give them a deadline (28 days is good) to pay you back. It helps if you haven't driven it since it broke.
Dunno how important the cod legalese is, but the upshot is I phoned them up, they tried to persuade me it would be better than it was, I said No, they gave me a full refund. No need for any letter or nastiness.
