I was in a car accident a few weeks ago, the other guy was clearly at fault and his insurance company accepted liability. My car is now away for repairs, everything is fine. My car suffered fairly significant damage to the driver's side - two new doors, repaired sill, rear wing, new rear axle, new rear wheel. I would estimate other guy was doing 20-30mph when he hit me. Luckily my kids were not in the car but I did have a car seat in place. Now a friend says I shouldn't really use the child seat anymore. Is this true? Should I be asking his insurer to replace it?

If the seat was not in use at the time and was not involved in the damage, it's probably OK to continue using it. Assuming it was restrained by a seat belt and this was properly tensioned, the belt itself will probably be OK for continued use.

Having said that, would I be prepared to trust my granddaughter to that seat and seat belt? Probably not. I'd be thinking very seriously about asking for them to be replaced.

The nearer they were to the site of the damage, the more likely I'd be wanting them replaced.

I would probably continue to use it for the time being but put a claim in for a new seat for piece of mind especially as it wasn't your fault.

Ask the manufacturer of the seat, if they say in writing that it should be replaced then the insurance company would have a hard time saying no to paying for a replacement.
