NCP Parking PCN
Discussion
Hi all. My friend has received a Penalty Charge Notice (PCN) from NCP for driving into and waiting in a NCP car park. This small car park has a generic NCP sign at the entrance, but no terms and conditions signs, method to pay facility, parking QR code signs are anywhere in the area. The PCN was also issued via the licence plate/DVLA information by an ANPR camera but there was no signage advising the use of ANPR. This I believes contravenes the guidance set out by the British Parking Association regarding use of ANPR. They have repeated this parking many times over the last 95 days, the time of the first PCN date of alleged offence to the date of receipt of the PCN 3 days ago. They have appealed the PCN via the NCP's own web process, this was rejected within 2 hours! Does anyone on here have any thoughts and /or can recommend a good lawyer who is well versed in these type of offences. Cheers, Peter.
There is no way to fight a penalty charge from a private carpark operator. They are judge, jury and executioner. So the process of appealing using their own process (as you have found) is pointless. Ultimately you have to take them to court or they have to take you to court depending whoever wants to go the furthest. The easiest thing to do is to ignore them and hope they go away. They are just a private company at the end of the day... so you're not really under any obligation to work with them as you would be if this was a ticket from a local authority.
In the past NCP have been the least litigious of any PPC. I'm not sure if that has changed with them. My Dad once got an invoice from them where the machine swallowed and mashed his debit card. NCP issued an invoice which has been ignored since. There have been a few letters from them that have been binned.
