Good evening,

I recently bought a 2016 X6M from one of the main online car retailers.

I purchased it on the 24th December and the issues flagged up on day one. On day 4, I phoned the retailer and flagged the issues, explaining that I would rather keep the car and have the issues fixed. They said that it wouldn’t be an issue and the faults would be sorted.

Took it to one garage, they said they couldn’t fix it, it would need to go to BMW. They told me the faults.

I took it to BMW, they agreed that it needs some work. Knackered ball joint, vibration from the transfer box, SOS Error light, along with 3-4 other error lights and an oil leak.

BMW phoned the online retailer and they refused to accept the quote, rejected it and told me to go and collect my (broken) car. I’m now being told that they refuse to have it fixed and that I need to reject it via the finance company. I don’t want to reject it, I want the bloody thing fixing!

I rang yesterday, got told the same thing and got nowhere. Emailed, ignored. Forwarded it on - no response!

I assume their 90 day warranty stands for nothing then, surely a retailer can’t just refuse to fix a car they’ve sold?

Any advice welcome.

My advice is - reject the car and don't enter a war with them. You'll be thankful in the long run.

Yes, they can. The retailer has the option of either repairing the car, or taking it back and refunding your money. That's pretty much standard with any warranty, as well as consumer rights.

I assume it's considered beyond economical repair by the dealer, and so it's not unreasonable for them to not want to fix it, and to give you your money back instead.

Personally I'd just accept the refund and move on.

I accept your opinions, thank you. But they aren’t accepting the car, they’re asking me to reject it via the finance company - effectively making it the finance companies problem? They aren’t offering a refund?

PCP? Finance company are the legal owners until it's paid off. Garage can't give you a refund for a car you don't own. Speak to Finance Co.

Here's a question for you.
Where do you suppose the finance company will go to get their money back?

If it's Cazoo then I'd act pretty fast given their current situation...

Yep. Wouldn’t be surprised if they go into administration by the end of 2023

Reject it via finance Co. and buy another one. It sounds like this one isn’t something to lumber yourself with.

The retailer aren’t going to fork out for the catalogue of stuff that needs fixing, some of which sounds quite nasty.

This is where the car being on finance becomes useful - he’s isolated from Cazoo.

They aren’t gonna pay for that repair.
They’re just gonna push the car back into auction instead.

Just return for a refund and be the end of it. No need to be awkward about it. You may get stuck with a lemon if cazoo go into administration

Assuming the on line dealer is cazoo try

alex.chesterman@cazoo.co.uk ceo

Might help but might not .
How much would the repairs cost if you were to pay it yourself say if they refunded you a % of the money if you like the car enough to want to keep it ?

They're ten a penny. Get rid like they've advised and buy a decent one.

From a used car dealer/garage.

Not somewhere trying to sell you the second most expensive thing you own in the same fashion as buying a spare phone charging lead from amazon.
