As the title says, I had an accident (non fault rolleyes) yesterday and have their details including policy number. Unfortunately I took a photo of his confirmation on his phone but didn't realise the company details weren't there. I was going to ring and see if I could deal direct as I've had before with a non fault claim.

For added comedy here's a picture. I'd stopped while he was still 5m off but he started swerving and there's a load of dust in the middle of the lane so didn't stop in time. His nearside wheels weren't actually touching the bank. eek

Any bets how it'll go? I suspect 50:50 as it's his word against mine, although his girlfriend apologised so I might get lucky.

I'd let your insurers deal with it as looking at the picture and the width of the road I dont see that going 100% at the other driver.

His girlfriend apologising assuming she was the passenger is pretty irrelevant, when she gets over the shock im sure she will back her partner.

I get where you're coming from but figure it's worth a go just for simplicity. If I get them to accept it they'll loan me a car, if I can't then I need to buy (or hire) something this weekend.

I will be amazed if it doesn't go 50/50 if the other party doesn't admit liability. They will conjour up a story where you are partly to blame. Your ins co may have an accident management company that will hire you a car, if it is at least a 50/50.

That’ll be 50:50 all day all night.

Let your insurer deal with it.

How can that be considered 50:50? Presumably the VW failed to brake in time, panicked and drove up the bank to try and avoid a colision?

Happened to me, I stopped, near side window in the hedge, watched as a 17-year old in a tractor with a trailer came barrelling towards me, not stopping, took out the side of my truck, took another 50 feet to stop leaving massive skid marks, apologised for “causing it”, even apologised again on a text message saying the same thing.

Ended up going 50:50 as he changed his story and there were no witnesses.

Still makes me mad to think about it today and it was 3 years ago.

“I was driving at 15-20mph down a country lane when a madman going far too fast came towards me. I was convinced he was going to smash into me so I instinctively swerved to the left and ended up on the bank”.

Without a dashcam or obvious skid marks on the road it’ll be hard to disprove.

Also a comment made last night! biggrin

He's insured with the same company as me so I've reported it and they are currently saying it sounds like the other guy's fault. We will see.

On a train to look at a replacement as I type. Sounds like an enthusiast so I'm optimistic.

Good luck with it - nice to see you’ve kept your sense of humour.
I hope you get it resolved and they accept liability.

Sadly, this is exactly what will happen.

There's a definite skid mark that is behind his tyre and curves as he impacted us, so I'm still hopeful.

Looks like a main road in Dorset. Bonus that it doesn't have grass down the middle.

OK, so he hit a stationary vehicle. I think that might help you.

You'd hope so, but this still his word against mine.

Dashcam would be worth it's weight in gold in situations like this with no witnesses. And you don't even have to be a DCW to own one!

Well, as I expected it's gone 50:50 due to lack of witnesses. rolleyes Apparently "FFS just look at the pictures" doesn't count for much in court.
