Help! Garage refuses to acknowledge fault

Hi there,

I’m hoping some more experienced people on this forum can help me. I am really stuck. Apologies if this is the wrong forum.

In the summer, my 440i was crashed into causing some minor damage to the rear left wing, which needed replacing. After an extended period of inaction, my insurer - One Call Insurance - arranged through their One Call Claims management subsidiary for it to be repaired by an OCM Garage in Swansea.

It was returned to me a week ago with a number of issues. This includes a replaced rear wheel and tire with a slow leak (a safety issue), and some kind of electrical fault where there is no audio at all, no Bluetooth etc. The car also thinks it is the 10th of October and there is no time / date (or any way to change it).

The garage took possession of my vehicle on the 19th September. It was returned to me last Friday. I have been informed today after a week of constant chasing through the online chat portal that they are refusing to acknowledge any part in causing the electrical issue. I’ve not been able to speak to a real person and I’ve hit a total brick wall.

I’ll be really grateful for any advice anyone has about what I do from here. I don’t know who to complain to (they’ve said a complaint has been lodged on the system and they’ll reply within 8 weeks…), who I can turn to for advice, or really, what to do. The agent on the online chat said the garage’s decision is final, so I have no idea what to do from here.

I’m going to get the tyre looked at today because I’m worried about the safety aspects but the rectification of any electrical issue could be expensive and I’m loathe to pay for their failings. I just don’t know how to proceed.

Your contract is with your insurer - go back to them ASAP

Erm, how do you know they caused the issue? It's one thing needing it fixed and another to say they caused it

Personally I'd invest £100 or so getting the fault diagnosed by a BMW specialist or main dealer... this way you will hopefully know what might have caused it and then can draw conclusions.

Similarly, have the tyre checked out by a tyre place for leaks. May just be bad luck and a slow puncture.

It might be unrelated
It might be a quick/cheap fix (possibly just due to the car sitting around while being repaired, battery being disconnected etc)
It might be obviously caused by the accident
It might be obviously caused by the workshop during repair

You'll be in a stronger position to move forwards with a proper diagnosis.

Keep a full, detailed paper record of everything that's happened so far.
Get the car sorted out by BMW on the basis they will give you a detailed written assessment of what they had to fix, and why they had to fix it.
Send the BMW report and bill to the insurer with request for repayment within 21 days.
If not paid, issue an online claim against insurer for the cost of the fix.

A few years ago I bought a policy from One Call. They wanted me to post them my licence. Not upload, or send them a copy, actually send them my licence through the post. That struck me as amateurish, so I cancelled straight away. They charged me £50 'admin'. Not a company I'll be using again.

Just go to your local tyre shop and tell them you want them to check a slow puncture which is a £10 fix.

Don’t go to somewhere big like Kwik fit they may try sell you a new tyre.

Disconnect the battery for 30 seconds and see if this resets your system so you can enter date etc small chance it will fix if not no harm done only takes a couple of mins and a 10mm spanner or socket.

Also worth buying a cheap scanner for bmw the ones from creator are cheap but good and will come in handy many times over in the future .
