I’ll try making story short
I lent my sons bf monies but van for his new business. He’s gtn points congestion charges & not doing anything bout them. Wanted v5 stay in our name till monies paid in full, so points are in our name not his. I know for fact he’s ignoring them, there’s now 30 points outstanding. He’s stopped paying me. Realistically I’d like v5 be back dated so that he’ll get all outstanding correspondence . I’ did write dvla 12/23 to no avail. I’m just scared, my anxiety through the roof as u can imagine. I’m not sleeping, just want him to take responsibility for wot he has done. Points are on motorway so no face is visible on photo they take! Sorry for waffling

The V5 change should have been done properly at sale time .

Confusing post.
You are the Registered Keeper (RK)..
Are your recieving NIPs (notice of intended prosecution) ie. for speeding offences or is it just congestion charge/parking etc?
If the former, you just nominate the driver then it isn't your problem.
With the others, Keeper Liability should only kick in if you don't name the driver. However I am not 100% on the process here.
Of course, if he denies it at that point it gets more messy.
Short version is I didn't think the keeper could be held liable if they name the driver.

We’ve put him down as driver, when we were speaking I got impression from him that he was not going to adhere to them. He did want them sending to him without going back to the constabulary it came from, which I did not adhere to at all. We’ve had 2 of them back that’s why I know he’s not adhering to them. We’ve not had any prosecution letters as yet. We live up north he’s down south that’s where the points are, just annoying they can’t see pic of the driver… mite not come down to us gtn into trouble but if v5 was backdated then all correspondence will be directed to him. He has told us min he gets v5 he’s selling it so his name won’t be associated with van at all, that’s why I know he’s not going take points, believe there just sat there. He would throw my son under bus to save his own skin! Sorry for waffling

Just trying to unpick this...Looking at the 'points' presumably for speeding.
So, you have had a NIP and an invitation to name the driver.
I think you then sent that back to the Police, naming him as the driver.
If so, so far so good. For reference you shouldn't ever pass those on to the driver, as that isn't the process.
Guessing from here that he then filled your name in and sent that back, creating a loop.
If so, it sounds a very dangerous game where he could in theory be seeing jail time for PCoJ.
It helps - if I understand it - that you as RK are located in the North and all the offences are in the South where the driver lives.
If you are able to prove your whereabouts at the times of the offences, you shouldn't have a problem. Check your diary, bank, petrol receipts etc which may all help prove it isn't you.
You can only get prosecuted for failing to name the driver.. and you have named him.
It is just a matter of getting the Police to understand that.
I would never send anything to him. I’m very by the book. I’ve sent letter to relevant police forces explaining situation. We have got proof my son was here up north when offences occurred, but I’m born worrier.
Just thought if v5 could be put down as date offences occurred /started then we’d get no correspondence at all once v5 is transferred. Beggars belief how that van is on road with that many points on it, am I being stupid thinking police forces care bout that? Please don’t think I’m not slaying them in anyway just asking question. Just for clarity, the V5C doesn't show who 'owns' the vehicle (it is written all over it), but rather it who is 'responsible' for it, usually for taxing, insuring etc.
People don't see it like that, but the only thing that is relevant for ownership is the receipt.
It is still the driver that is responsible for the offences.
You as the RK have discharged your duty by giving the information in your power.
If this got moved to SP&L you might get better replies (better than me!), but I am not sure if that can happen as a new poster - try reporting it to the mods and get it moved?

He’s shown his true colours showing how nasty malicious disgusting he actually is, his ansa if we say anything is ‘GIVE ME V5 THEN’ I wish we could but I now know if we do I’ll not see that monies. Makes every excuse why he ain’t paying me, showing his true colours in fact he’s said he’s selling van min he gets v5, he’s hoping that nothing can come back to him by not being associated with van so to speak… My son is absolutely disgusted with his bf! Btw their not bf’s anymore, we’re doing it together but if he hears somat he dunt like he just ignores us & doesn’t pay me. Mite not sound lot to some folk but I do struggle with severe depression & anxiety this is knocking me over the edge, just can’t see way out, only 1 I can see is give him v5 & loose the 7.4K he owes me, I can’t afford to but I just can’t go on way things are

If you're using the V5 as proxy for ownership, and refusing to give it to him (i.e. transfer ownership) then how does he owe you money? You've basically just lent him a van at this point. Get the deal in writing, transfer the V5, then MCOL if he doesn't pay. Or, call the whole thing off and take the van back. You kind of need to conclude the deal one way or another, and get out of this halfway house you're in.
