Registered Keeper wrong
Discussion
Hi,
I have had a minor car accident - car hit us from behind. Was getting claim processed with insurance and it was deemed not economically repairable so have been offered pre-accidental value for it. Great and all. It was non-fault accident.
Problem is when i did insurance, i filled the owner of the car - correctly- which is the leasing company as i have finance
the registered keeper - i did me, which i am not, its my sister. (policy holder is me - and i just put registered keeper as me.....)
Did not realise till now? Why? no excuse really
missed it due to my own incompetance
Does this mean, policy will be cancelled - no insurance, no claims, no injury claim or anything?
Damm, might have really screwed up ??
only good thing is its non-fault so i wont owe them anything anyway ???
can people let me know what this all will mean to me? what might affect me in present or future from now?
Thank you and please be gentle
i know i screwed up....

On a point of order, with a lease, the lease company are usually the RK as well as owner.I have had a minor car accident - car hit us from behind. How is it that your sister is RK in the first place?

When we got the car, she bought it and she financed it with ofc, her intention of using it but thing happened, and we swapped cars and suchHow is it that your sister is RK in the first place?
We were meant to change the RK but it obviously slipped our mind
And when i filled the insurance policy, i thought i was the RK but now i realise the mistake i made
But yea, the V5 book has her name so she is the RK

But be very careful because this looks like 'fronting'.

Sorry, I should have been clearer.
With a lease, the lease company is usually the RK.
Neither you or your sister would normally be RK in that situation.
In any case, in answer to the insurance question, if your claim is against the third party, then the pay out from their insurance company should not be affected by the RK discrepancy, unless they claim that you were not actually insured at the time.
However, even then, I'm not sure that the third party can avoid their liabilities even if you might have been technically uninsured yourself.

I am the main driver so my name is on the insurance - i am the insurance policyholder. My sister isnt mentioned on the policy at all - only I am on the insurance policy and the only driver - i am not using her name as main driver or any driver for the fact, to get cheaper insurance so is not Fronting i believe? But be very careful because this looks like 'fronting'.
The only problem here is, the insurance has RK as me (my error)
while it is my sister in V5 (stupid error from me)

Because when we did it with them, they just issued the V5 and had RK as my sister. (was ofc meant to transfer to me but didnt and here i am
)The car is categorised as S. They have offered me X amount for the car value
I am sure I will have to send V5 book to them to complete this
when they see the RK is my sister while in my insurance i have put me as RK, feel like they will make my insurance void then
not sure if its too late to change now....

Nobody is going to care. Stay quiet, accept payment, move on.
the thing is to get the value for the write off - i have to send V5 to the insurance company and they will notice its under different name - the V5 is the registered keeper and its my sister's name
Owner is HP finance is the lease company (god i hope i got that right too -.- )

Does the RK really matter? So far as I am aware it has no basis in law, merely the person to which official notices are sent. The RK is not the legal owner and it is usually the driver that must be insured, not the RK or legal owner.
Only in so much as in this case the OP gave incorrect information to his Insurer and it is a pretty standard question.Usually it does make no or little difference in premium especially if its a wife or partner that is the RK.
In the OP's case I think he could say that it was only an (and a genuine one at that ) and had he informed them of the correct answer ( his Sister ) at the time I doubt it would have made any difference although conceivably the Insurer may have charged slightly more perhaps.
I very much doubt the Insurer would upon knowing this be in a position to either decline the claim or indeed cancel the policy abinitio as the error is not material.
Any Insurer trying to cancel would have to prove that it was their usual strategy not to insure a car for whom the RK was a sister - v v unlikely.
Personally I would imagine that telling them the error the worst that could happen might be to try and take over a small amount of money to prove their point that had they known at the outset they would have charged this extra -but I think this unlikely and even if the case it would be a very small price to pay.
As to back dating the V5 again personally I wouldn't try as that to me potentially seems to move from a small error to a real issue and you don't want to allow the Insurer to start suggesting so !
