copart -uk sold my car when i told them i want it back

on the 12/11/2024 i had a car accident [ none fault ] i contacted the aa who in turn put me on to a company called ax-uk a 3rd party insurance company they took over from my insurance company they told me to cancel my insurance with geoffrey insurance as they will do all the work so i cancelled my insurance with them i emailed ax the damage done to my car. just the front bumper and headlight needed replacing they told me it would be written off due to the age of the car they sent a company called copart a salvage company to collect my car who in turn told me my car is only worth £210.99 scrap value[ they even sent me a cheque which they later cancelled as i told them i refused there offer] i told ax i wasn't going to accept coparts offer and would like the car back so i can repair it my self they said ok. the 3rd party paid out £1.420 i was told by ax copart would send my car back to me. i never heard nothing for a couple of weeks until i looked on coparts website my car was up for auction i phoned ax and told them about it they said they will contact copart and call me back about 1 hour later they called back telling me they spoke to copart and said they will take the car off auction and send it back to me they didnt they sold my car copart keep telling me they are investigating this has been going on for weeks now now i have a letter from dvla saying someone has requested a new log book im fed up of copart fobbing me off with excuses i now have to walk and and get public transport this has caused me stress i dont know what to do can i take legal action against them thank you

First of all what's the car - age, mileage etc? And how badly damaged was it? Any photos?
It doesn't seem right that you would need to cancel your insurance with Geoffrey so the accident management company (AX) could take it over. Usually your main insurer would remain involved to ensure a satisfactory outcome.
I don't think Copart are in the wrong here, suspect it's down to a lack of communication from the insurance company/companies.

This does seem to be a trend, insurers use Copart as the assessor. Definitely no conflict there, a company who wants stock to flog at auction getting to pick which cars are written off...I know someone who had the Copart truck arrive at their house expecting to take away her car "for assessment". Fortunately she gave them the big FO, and her P&J was not a write-off after all.
ETA Appreciate your forum post is a brain-dump, suggest you sit down for an hour and note down all the facts, dates, times, any record of the calls from your phone's call history,.emails etc. Keep it to bullet points.
Then call your insurer with that list in front of you,. explain and ask how you get your car back or get sufficient payout to buy a similar condition/age uncrashed car. The £1,400 hammer price of yours should be the bare minimum as the insurance should have returned you to where you were before.
Follow up with a.letter. if you get nowhere, raise a complaint. If complaints go unheeded you need to raise it to the ombudsman.
And FFS people, can everyone stop using accident management sheisters? They push up premiums for everyone.

The £1420 payout looks fair given values of similar cars.
Unless your Megane was of particular sentimental value I’d buy something else and move on if it’s stressing you out.
What exactly would be the basis of the legal action? Do you have anything in writing or time/date of conversations with the insurer? Why did you let Copart take the car away?

AX-UK appears to be the new name for Accident Exchange.
Apropos of nothing, I won a week in a 997 911 on here in 2008 which was in conjunction with Accident Exchange.
Unpacking this as best I can, it would seem the OP called the AA when they were hit and not their insurer.
Their insurer appears to be Geoffrey, a brand ultimately of Markerstudy.
The AA presumably get a kickback from AX-UK if they refer to them, so off the OP went to them. Presumably AX-UK put the OP in a credit hire car and have billed the Third Party's insurer for many multiples of what the OP received in respect of car hire, claims handling costs etc.
God knows why AX-UK suggested the OP cancel the Geoffrey policy. Especially if there was a chance the OP planned to retain the salvage.
In my experience it is conventional for an insurer to instruct Copart to collect if it's likely the car will be a total loss. Why bother paying for a collection to a busy bodyshop only for it to arrive and the bodyshop/insurer engineer to realise that it actually needs to go off to salvage auction?
Sadly, that seems to be where it's really gone to pot, as someone has neglected to tell Copart that the OP is having the car back.
If, as already said, the settlement is enough to buy a similar car then I'd chalk it up to experience and buy another car. Which probably won't have a cat marker on it. Or been moved round a grotty salvage yard on a telehandler . . .
But if the OP is going to incur additional costs as a result of this, then those should definitely be put to to AX-UK and/or the Third Party's insurer.

the payout was from haven op ins on the same day of the accident i sent pics to ax-uk who told me they would write it off they arranged copart to collect the car i had a hire car from ax i have a email from ax-uk stating the 3rd party ins have no interest in the car and i can do what i wish with it as it was just the bumper and head light needed fixing i said i want the car back i was asking them for weeks

Who were you asking? Also, worth bearing in mind Copart will be acting upon instruction of the insurer... if the insurers have advised Copart to dispose of the salvage, ie sell it then your beef may lie with them, not Copart. Also, you say you were paid out on the day of the accident? So usually once there has been a cheque written, ownership then transfers to the insurer so maybe by this stage it wasn't your car to retain anymore?
You need to speak to your insurer or the accident management company but not sure what you hope to achieve? If the car is sold, gone then that's that... Copart won't sell a car that legally isn't theirs to sell unless they are selling on behalf of the client, ie the insurance company who has paid out the policyholder.
Call the insurers.
Ok, thanks for the info, sorry to hear how this has played out. You could spend a lot of time hassling the various companies involved but if the car's been sold and you've had a payout, really it's just a case of moving on. AX didn't need to be involved at all with this and have simply added more complication and cost to what seems to be a relatively simple claim.
Hope you can find a good car to replace the Megane. If you were fond of the car it shouldn't be too tricky to find another Megane dCi to take its place.

It's just not going to happen. Every party remotely involved signposts towards them. Even the insurance companies themselves.I remember when I worked in the industry. Diminuation was a word commonly thrown around with regards to costs... apart from when referral fees and profits were to be made!

I suspect they told him to cancel the claim with his own insurer, as they would manage a claim with the TP insurers. I doubt very much they told him to cancel the policy.As noted, the car is now sold, so all that can really happen now is agree a sensible settlement with the TP insurers, to include any uninsured losses and then go buy a new car.
A complaint to AX-UK (once the TP settlement has been finalised) might be therapeutic, but doubtful they are going to make any more than a nuisance compensation payment once the OP has a market value settlement from the TP insurers, frustrating as the situation may be.
