Sutil to stand trial

Reports from planetf1 saying Sutil will stand trial in Germany later this month on GBH.

Relates to the incident last April in Shanghai.

It just a fight- seriously a night out in a city and these thing happen all the time; all the police do is tell the fools to stop it and go home or be arrested.

Silly of Sutil, but mountain out of a mole hill. It has affected his career as well.

I hope Sutil's case is dealt with the same way as a chav scum's one would, for doing the same thing.

I'm even less clear how a German court thinks it has jurisdiction over an incident in China...

Could it be that they will not let him be sent to China for trial unless they are satisfied he has a charge to answer? Or as the accused is a German national, if the victim reported the offence in Germany, would the German courts take it on?

Slashing someone with a bottle is the sort of offence that doesn't just get broken up by Plod and you're sent on your way.

Pretty sure most crimes can only be prosecuted in the country where they are alleged to occur - esp something like assault (rather than something like a war crime).

I'm a Brit and live in the UK. If I slapped a policeman in Paris, I can't see that a court in the UK would prosecute me.

I agree, but there must be more to it - for such an injury - why did the victim or his friends (or the club, or the hospital) not call the police?

My guess is that there were other substances or illegalities around that drove them to getting out of the club, have the team doc attend to the wounds.... Then go legal once out of the country...?

This is a pretty nasty attack actually. 24 stiches is probably a lot.

I'm not a fighter by nature, but am of the opinion that little scuffles can sort themselves out. However, if some numptie bottled me and I was injured in such a way, I would want them prosecuted.

So I am in agreement, can't just let Sutil off. Sets a bad legal precedent.

Probably not, but they could, similarly if someone slapped you in Paris they could, in international law these are the nationality principle where a government can claim jurisdiction over it's citizens wherever they may be and the passive personality principle where a government can claim jurisdiction on the grounds that one of their citizens has been harmed.

Well, yes, but seeing as Sutil has already admitted and apologised for causing injury, I think the question is more of "intent", "guilty of what offence?" and "under what jurisdiction?" rather than a question of whether he did in fact injure someone:

from what i know he threw a glass or a bottle and that's what caused the damage.
Doubt it was intentional, probably just drunken high jinks.

All the F1 boys party very hard. You'd be surprised what they get up to post race !
