Drive-through penalties cannot be appealed.
Referring to McLaren's appeal, an FIA official confirmed to the British newspaper The Times that he was "not sure if it would be admissible."

And you cannot appeal a drive through penalty - but yes, the drive through was applied after the race as a time penalty - but if you follow the letter of the law - then Mclaren can't appeal something

Time penalty is the post-race equivalent of a drive through.

Had it been a drive through, applied during the race, precedent shows it could have been taken at the end of the last lap and not affect the time of the driver. Alternatively, precedent shows that rather than a retrospective drive through, a fine should be imposed.

Sadly, although it was the wrong decision by the stewards, McLaren will not be allowed to appeal on the technical grounds as mentioned above.

But I suppose those in red would be allowed to moan, bh and suck cock until the cows come home until any similar penalty was overturned...

Penalties of driving through or stopping in pit lanes together with certain penalties specified in FIA Championship regulations where this is expressly stated, are not susceptible to appeal.

The grey area is, was it a time penalty or a drive through penalty that was served post race.

Can i get a job as a technical advisor for one of the teams please !

The info coming out of Woking is that Mclaren aren't appealing and that they are going to simply concentrate on the next 4 races

I suspect that ban on appeals for such penalties is mainly because, in the case of a stop-go or drive through, there is no mechanism for undoing the penalty post race. The race would have been very different if no penalty had been served - I guess reducing the drivers time by 25 secs or similar might be a suitable way of doing it, but the drivers demoted could then have cause for appeal and so on....

In this case the mechanism for undoing the penalty is straight forward as the penalty was applied post race - so I hope that the FIA see sense and at least pretend to reconsider what happened and the penalty applied.

I wonder how long it will take this weekend before the 'dirty tricks' campaign starts against McLaren to upset their weekend.

i.e. Lewis being hassled, luggage stolen, made late, police turning up in the garage, writs being served, threats of court action.......

It's totally unbelievable but they cannot appeal a drive through. (of course it makes sense during the race that you can't appeal)

If they had penalised him with a Time Penalty, which they could of done, then it would be OK to appeal - clever eh !

All well and good, cut chicane and get a drive through, fine, but to take 3 hours to decide this then apply it after the race and using a penalty that assures no appeal to me smells bad

I just think this whole event has dampened what was an amazing race.

It makes you think, they must have forseen this outcome and understood the effects on the sport. It's anything but good plublicity.

Although, I haven't hear a race debated as much as this since the monico 2 seasons ago, and as they say, any plublicity...

i know this is slightly off topic...but since we are on the theme of "after race" penalties......does anyone if anything happened to Massa after the previous GP (when he cut that car up in the pits)? Stewards said they would review after race...but i never heard any more.

Well there's a bad precedent being set here. The track stewards can issue a drive-through penalty, in the closing stages or even after the race which could determine the outcome of the championship. There is no opportunity to appeal the decision, and if it's done after the race the driver has lost the opportunity to do anything about it on the track.

For example, had LH known he was getting a penalty he would have had the information to push for as much as a lead as possible, rather than just finish first. This could happen the any driver at any time and the lack of appeal opens the door for unscrupulous interfering by anybody.

But not mowing down pit crew or nearly crashing in the pits. Obviously.
