McClaren Three Race Ban ?

McLaren was suspended for three races, escaping a more severe punishment that could have derailed Lewis Hamilton’s bid to repeat as Formula One champion.
The World Motor Sport Council issued the suspension because McLaren lied to officials and committed other breaches of Formula One rules at the Australian and Malaysian Grand Prix races.
The council said in a statement that the team admitted to five charges of breaching the International Sporting Code. The three-race suspension will be applied only if McLaren commits a further rule breach or if new facts came to light, the statement said.
So are we missing the point here, the FIA found Hamilton responsible and then decided to apply a three race suspension next year if there was another rule breach, should he of been made an example of to prove the FIA still has the minerals. Hamilton was ultimately responsible, he was driving the car.
I don't think a three month ban should be hovering on next years season, surely a one race ban this season would be harsh enough and would remedy the issue so Hamilton can move on.
Also what happens next year if McClaren build a championship winning car using the loopholes Brawn exploited this year, and then get found guilty of that receive said suspension. Would that not be a huge defecit for next year?
