Might be worth reading these postings from the Vectra owner's club re problems with getting car MOT'd. It would appear the law is far from clear and some MOT testers can fail you if they decide to be picky.

On our V5's it states the the dB level that the factory system outputs. So no doubt if things get even stricter, testers can, if they feel they need to, look up what the levels should be and just fail the car.
My wife's cousin who works at an MOT station says that MOT's with regards to performance/modified/import cars are going to get even more draconian over the next 5 years in an effort by the government to try and force these cars off the roads. Cheering thought..
Just edited to agree with Paul-C's comment re the Max Power type cars, the systems on those cars are the cause of MOT testers clamping down. The wife's cousin says that some of the systems on these cars are badly made/fitted and are on cars with such stupidly small engines. He does go onto add that my car with the Sport Pac set up should pass. He just loves the sound it makes when it rumbles into his garage

If my memory serves me, the testers manual states that the noise should be similar to that which other vehicles of its type make. Pretty ambiguous!
A mate of mine runs a hot rod which has 8 pipes straight off the engine no more than 2 ft long and no silencing. MOT man passed it on the basis it was a hot rod and all hot rods are loud!

Its down to the discretion of the MOT tester, if he thinks its louder than an origonal then you have no chance especially if you make a bad impression when you arrive i.e. chav style. The same goes for bikes, have seen them passed with straight through pipes on a Harley but lets face it you expect a Harley to sound loud - the same as a V8, however a 1.1 Nova..............I don't think so
the rules simply state that the exhaust must be effective in terms of leaks and silencing.
on the basis that the car has a v8 its acceptable for it to sound as if it does if the exhaust is operating effectively.
by comparison an old shed with corroded silencers could fail.
there are plenty of friendly MOT stations about, my old cerb was ear shatteringly loud at 120db and passed fine.

It passed because knowing TVR's, it probably spent a lot of time in the garage and the mechanic thought of it as his own

I know I shouldn't laugh..........but that was a 'coffee spat over keyboard' moment
