Urgent Legal Advice on Purchasing a Car - Help.
Discussion
You should have an invoice that quotes figures - need a lawyer (which i am not) but if that is the price on the card then no problem.
If the dispute is them claiming the handling charge then that needs to be in the agreement between you and them and clearly in writing as per amounts.

Again not a lawyer but would suggest they need to take you to court to get the cash (how much would that cost) but based on the form (bill of sale) you are liable for the total cost, but it is down to them to reclaim it, giving it easily to them is best for them as a court case takes time and money - you may be able to offer them money to go away!
ok.... i'm not a religious man (unless you count the church of sport & rum) but I do beleive in karma of sorts - wot goes around comes around etc. I've certainly been undercharged by people & said nothing and prob been overcharged & not known. But if I knew the former had happenned & the bloke called later sayin he'd phucked up, I reckon I'd pay - esp if I was happy with the correct price in the 1st place. If however I felt they'd jipped me, I wouldn't pay or I'd at least let them sweat it out 4 a bit. We've all made mistakes & the blokes prob gettin a bollockin over it so rather than give card details I'd send them a cheque for the diff. thats my 2 bob's worth - I'm sure they are screwed legally, but lifes bigger than a couple of humby IMO.

Spot on.
dont pay
seriously why?
example: I bought a widescreen tv and an xbox360 at Christmas from a very big chain. The 360 came with 3 bundled games - each placed on top of the box. I had a 4th game I was going to buy and it was placed on top of the 3 others by the check out girl - she then didnt scan it
Did I pay? No
For what serious reason should you give it them? Their mistake. Now what about if you hae an issue with your car, we all know just how virtually impossible it is for a dealer to sort problems out (in the main, thats excluding some on here!) so as far as I can say

You have just saved 9grand on the car how much else you wanna get away with, stop being a tight git and pay the difference!
Legally they dont have any grounds if it is written on the form and that form has both your signature and theirs on it.
However as mentioned the bloke is probably getting a total grilling from his boss for it, inevitably you will have him on the phone shortly aswell, but it all comes down to you, if you can sleep knowing whats happened feel free not to pay but personally I would.

I guess this is karma too... they might be getting it back for being used car salesmen!

indeed!
Law wise I *think* (from my limited research into a possible career in it) that you are only liable to pay the TOTAL amount on the bill. If the garage has stuffed up the sums that is their mistake, not yours so therefore I think the law is on your side. Morally speaking I would say stuff the them seeing as they are a big firm who make money by underpaying people for their cars and selling them on at extortiante prices. I am also fairly certain that £270 is a lot more to you than it is to them. Having said that, if the guy owned up and said 'I'm sorry, I've made an honest mistake and I'm getting a bollocking for it' I would give him the money for having the balls to own up to making a mistake and then get him to buy you a pint later on. Also if you go to buy a car there in the future, he might be willing to give you a nice deal

ah I missed that
still, my stance on this is tough tits on the sales guy. In my old line of work any mistake didnt cost hundreds it could cost millions and the buck stopped with me - I spent years bailing people out, covering for crap work mates etc so my views on others mistakes are fairly draconian.

If he had added it up the other way and overcharged the customer, and the customer had picked up the phone and said he had been over charged, would it be as fair to say tough tits to the customer ??
If you were prepared to pay the original price, and the guy has been up front enough to say he made a mistake, then morally I would pay it. But thats just me.

No, I'm sure Trading Standards etc. would take a dim view of that. However, that wouldn't probably make it any easier to get your money back, so this argument doesn't really fly IMHO.
If it were me I'd consider going halves on it if they're nice about it. It's their mistake, but we all make mistakes. However, if they're being funny with you, tell them to get lost and don't be intimidated.
From an ethical and moral point of view, if I'd been treated well by the dealer/ salesmen I'd pay it, as for I know it could be coming out of the salesmens comission. If I'd been
about,(like our recent Merc. experience) might be different.
However, from the business side of things, if it was my company, I would have rung to say (for the sake of £250) that we had made a mistake but won't be asking for the extra money, enjoy the car and bear us in mind for the future.Would have been common sense and good PR.
