I got stopped for my numberplate and now have a letter from the procurator fiscal?!

I got stopped by the Police on Good Friday.

It was due to the front numberplate on my Escort Cosworth being to small. I bought the vehicle like this ( I had only owned it a few days so was waiting on the documents coming)

I had not received the documents for the vehicle so could not get a new plate made when I was stopped.

The Policeman who stopped me said this wasn't good enough that he couldn't give me a rectification order.

So when I asked what I was supposed to do he said get a plate made.

I explained again that I had not received the documents through and he said it was not his problem.

I am never in trouble with the Police or anything and he had no reason to be unreasonable. When he was out of the car his collegue played good cop and was sound enough as he was a bit of a Ford fanatic.

Anyways he offered me a on the spot find of £60 to which I refused and I now have a letter from the court saying they want to prosecute me if I do not pay the fine.

I have no intentions of paying the fine and will fight it all the way as there was noway I could get a new plate made. I spoke with a motoring solicitor who said that they can't prosecute me for this but thought I would ask the forums.

how can you not pay the fine? Your plate was too small. Seems unarguable to me.

On what basis did the motoring solicitor say they couldn't?

I read this and understand this but I still couldn't get a plate as it was a public holiday and I had no documents the previous day.

But I couldn't get a new plate made due to

1 - It was a holiday and the motoring factors were not open to do so
2 - I didn't have documents to get this done

no-one made you drive it, that was your choice. You got caught.

He basically said that I did not have the relevant documents to be able to renew the plate and that I should of been given a rectification order unless he had another justification for giving me a on the spot fine.

You bought a car with a non-compliant plate. At that point it became your problem. You also seem to have failed the attitude test.

That would be my point, you knew the plate was illegal yet chose to take the minimal risk of being stopped, which you were. It's tough but I can't see why you shouldn't pay the fine.

I can't believe your serious?

The car wasn't legal to be driven on the road so you shouldn't of been driving it.

Not saying I wouldn't of done the same but the fact is you drove it when you shouldn't of and you're in the wrong.

Take it on the chin and pay up.

The PF can prosecute you for this, wither they do is another matter..

But is all the hassle and stress really worth the £60 to you?

At the end of the day you chose to drive the car with the dodgy plates. Offence complete. No ifs, buts, or maybes.

If it were me, i'd pay up and move on. The time and stress involved in fighting a £60 fine wouldn't be worth it to me.
