Hi,

Some time ago someone I know received an invoice from a “parking services” company, as he had parked in a disabled bay at an overly crowded shopping centre for 5 minutes whilst he used the cashpoint. Yes, he shouldn’t have used a disabled bay but it was for a very short amount of time and the car park is constantly overcrowded as half of it is now scaffolding to stop it from falling down. As suggested by various forums, he ignored the letters. They were actually addressed to his old house so were only delivered by the mail redirection service several days later. He hadn’t got round to changing the address on his V5 at that point. He still hasn’t contacted the company so they have no way of knowing whether he has received these letters yet. They don’t know who the driver is either.

However, he has now said he’s received a courts summons for the “fine” plus whatever else, now totalling £185. The company is a small company, well known online for issuing these invoices and writing threats. They’re not parking penalty notices and they were issued in a private car park, not a council car park.

Any thoughts on what he should do now he has a courts summons? Ignore it? Tell them he wasn’t driving? Go to court? Pay it?

I haven't seen it. He's actually away at sea at the moment so I'm dealing with someone who's opening his mail for him. I'll have to check...

More likely its just another threatening letter containing big scary words, designed to scare him.

It's more likely to be a 'demand for payment or we'll take you to court' type of threatening letter. They rely on people seeing the word court and thinking 'Crikey, I'd better pay up'.

Ask whoever is opening the mail to either read it to you word for word or take a photo and mail it to you.

I thought so. Still waiting for the person to get back to me with confirmation of where it was posted from and if it's an official letter from the courts.

The person opening the post is familiar with court summons and how it all works (he's taken someone to court twice), which is why I find it odd. I'll post back once I've got some more info...

I'd say this is extremely unlikely to be a court summons, or this is a misunderstanding (i.e. we are hearing some bloke on a forum saying his mate at sea who has another mate who has read what might be a court summons sent to the wrong address)....until we see the summons I'm going to say this is incorrect.

Also - OP, your mate is an ahole....I don't give a st about any excuses, you don't park in disabled spaces unless you're a tit.

I have no legs. Does that make me mammarian?


Seriously though, chances are it is a 'copy' of a court N1 paper, just to show they are not bluffing.

Failing that, they are risking the court fee on the basis that they are 'upping the stakes' to the fee, the fine and £180 extra.

It's £180 in total, so not even that much money!
If it is a small company, then they may try it on.

For example, if they know it is a 50/50 chance that whoever receives it pays £180 - If it costs them £20, they'll do it as a matter of course.

Not really relevant, more relevant is 'Do they have a picture of the driver parking the car in the space?' as a parking 'contract'is with the driver not the registered keeper.

If he was there for 5 mins perhaps someone will have been around for 5 mins to take a photo of him coming or going from his car?

He's hardly a lazy selfish stbag serving on the front line onboard a Royal Navy ship in Libya keeping the nutters under control for the last few months. Sorry he's not able to sort it out for himself.

Seriously. I've no love for these PPC's but this was a disabled spot so, no sympathy. For him that is, not the raspberries.

In that case remind him that if things go pear-shaped in the Med then one day he might be in need of a disabled space and he likely wouldn't want it to be taken up by some tosser who's too lazy to walk an extra twenty metres for his booze and fags money.
