Advice needed: continual insurance again!
Discussion
ok so hes the script.
im looking at getting a new car now that practicality isnt of the essence and feel an mx5 will quench my thirst especially after a large spell in a slow boring bmw 318 saloon: a car i disliked from the off pretty much from the supid accelerator pedal that comes out of the floor to the obtuse noises it makes.
anyway. ive just renewed insurance on the bmw, although it is monthly and cancelable and i would only incur "admin charges", the large supermarket company with im dont like mx5s, so i will probably need to change insurance companys.
the thing is with this stupid continual insurance is once ive got and insured my new car i cannot simply cancel the insurance on my current bmw and leave it with 9 months tax on the drive waiting for a buyer, i would have to sorn it making it even more unatractive to buyers. am i right so far?
being a young driver i cant really afford to insure both cars and have one sitting unsused eating up road tax aswell.
so what is my best plan of action? i ideally need a car at all times, and i will need to travel in my current car to buy my new one with use of my named drivers.

Unfortunately you may just be stuck with the holding costs for the second car. If you are looking to sell, SORN would be a big disadvantage, and if you need to take it for test drives to show folk what is what, as a good consciencous law abiding citizen the insurance is also essential.
The best plan of action (if you absolutely have to have a car at all times) is to organise yourself so you have the new MX5 yopu want (I am thinking of replacing my GTV with one incidentally) and the funding all teed up, and have a plan of action to sell the BMW (classifieds etc) ready to just 'press go' on once you have the new car (or have at least put your deposit on/purchased the Mazda). You could probably get away with a weeks overlap.
I am sure someone else will have a better solution, but I would suggest making sure your really on the button with your organisation simply to keep costs down to a minimal.

not really. Why cant you cancel the insurance, SORN it and leave it with 9 months tax on the drive??saaby93 said:
hy's that?
You only SORN if you have no tax or no insurance ( or both)
You dont have to cancel the tax or insurance if you SORN
I thought you had to send the tax disc back if you sorn? Or is that only if you want a refund on the tax? I wouldnt' want the BMW sat with no insurance, so why not just apply for the insurance refund (cancellation) once it's sold? You only SORN if you have no tax or no insurance ( or both)

If you weren't moving insurer then you could swap the existing policy onto the new car, pay the extra and then add the old car back on until you sell it. It's a service most insurers offer (allowing you to have two cars on one policy temporarily) to cover the time between buying the new car and selling the old one.
With the new ill thought out rules, if you uninsure a car you have to SORN it, and if you SORN it now, you have to send the tax back. I am in exacly that situation now where I have bought a new car and transferred the insurance over. I have had to SORN the old one and send the tax back, it is now sitting in my driveway uninsured and no tax with the prospect of selling it without allowing a legal test drive.

Who says you 'have' to send the tax back? You can send it back if you want the refund otherwise why not keep it?

Once the car has been declared SORN the tax becomes invalid, no you don't need to return the disc for a refund but the disc has no standing, it just becomes a piece of scrap paper.
So how is anyone supposed to know whether a tax disc is valid or not?Of course it's valid unless you send it back for a refund
Or do you have a source for unrefunded tax discs being invalid?
There have already been some threads checking the legislation.....

From the DVLA website
If you have a vehicle that is still taxed but not insured, you could face a penalty. This includes vintage and classic cars, motorbikes and motor homes – all vehicles that people sometimes leave uninsured for part of the year. If this applies to you, you need to return the tax disc on a V14 (including nil value discs) and declare SORN at the same time.

It's quite simple & hundreds of people tell you this every damn day.
Luckily some people read the regs
If you want to untax your car you need to SORN first ( even if its a picoscond)otherwise it's illegal
if you want to uninsure your car you need to SORN first
However once you have declared SORN there's no time limit on how long you can take to uninsure or untax or at all.
All youve done is declared your car off road.
There's also no offence of driving while SORN which you can if you have tax and insurance.
The only way of cancelling SORN is to take out new tax or become a new keeper.
If you find anything else that's new post it up

SORNing a car cancels the tax, it's that simple. It's not two things, it's one action. If you want to untax your car you need to SORN first ( even if its a picoscond)otherwise it's illegal

Could you be breaking the law?
If you're not using your vehicle, you should make a SORN. If you are using it, it must be insured
The change in the law means, you will only be able to take your vehicle off the road and cancel your insurance by returning your tax disc to DVLA.
It must be returned on a V14 (application form for a refund of a tax disc) and SORN declared at the same time.

There is always a gulf between what DVLA "say" and the actual law of the land.
Can any of the PH "lawyer team" give us the actual law on SORN and keeping a vehicle taxed or is this another instance where case law (when it is decided) will decide what is correct and what is not.
Regardless of the state of English law will the DVLA continue to spout misleading advice on this (and probably other things) that is to their advantage.

You are wrong - you can successfully SORN a car on line before the last month when the VED disc expires.
I have a car sitting on my drive SORN'd due to continuous insurance requirements - VED disc expires Nov 2011 - was not surrendered at the time of SORN on line
We will find out shortly if change of ownership means the car returns to licenced or something else.
