Evening all

I received a letter from Herts police asking me for details of the driver of my Skyline driving on the A1/M whilst dangerous driving/ and or driving without due care and attention.

Now it was me driving, but I don't recall at all driving dangerously or without due care and attention.

I possibly was driving over the limit, as was pretty much everyone around me, but if it was for speeding then surely they'd have evidence or pictures from a camera, or possibly would have stopped me if I'd passed a unmarked car. It leads me to believe I must have done something else wrong, but if they can prove I did something wrong then why didn't they send the evidence/picture or stop me in the act? I can't see how they could have seen me do anything wrong

Has anyone ever been through this sort of process? The letter asks for the information of the driver during the time of the offence.

I've never had anything like this so don't know what to expect.

Aany knowledge would be appreciated

I don't need the derogatory posts though. I know I must have done something wrong. Just don't know how this sort of thing goes

Cheers

I believe you have a NIP (notice of intended prosecution). You have no choice but to fill it in correctly. Give only your required details and wait to see the outcome. If an interview at a Police station is required then get a solicitor otherwise get a solicitor if it goes to court. You maybe lucky and get nothing back but I doubt they'd send you that without a pretty solid case.

One of my friends had one of these. Pretty much the same information asked for but the location of the event was in a different city. The date and time they mentioned in the letter he had a verified location he was at and the car was parked up outside that location. The police later phoned him and suspected his plate was cloned or the registration of the plate was very similar to his and was obscured somehow that made it appear the same (screw holes etc).

Depends if the case goes to court or not. Even if they only interview you I would take a solicitor. They maybe relying on you to implicate yourself when making your statement - your solicitor will aid you in your wording so that you dont make that mistake. Do you not remember what you did that day that would warrant the police sending you the NIP?

If its just an unrecorded letter, not an official nip throw it in the bin and ignore it. If they come and ask you anything about that day just say you dont remember do not say anything at all that will incriminate you.

Poor advice. It's probably a NIP and a 165 notice, in which case do not throw it in the bin!

I have had 2 NIP's in my time. Unfortunately I live in an area where people don't seem to like performance cars

One of them resulted in an interview.unfortunately a guy that lived nearby didn't like me and Apparently I was using a private road as a racetrack and doing handbrake turns etc. None of which happened, the road was barely wide enough for 2 cars! I was there sometimes twice a day as it was a friends place, so was just a target.

Went to the cop shop. He asked me about the accusations, looked around my car and I never heard anything else.

Dont really agree with taking a solicitor as it could make you look guilty

Nah this was on the 6th. All good then.

NIMBY - Not In My Back Yard, as people have said. Curtain twitchers, interfering old bds, whatever you want to call them really tongue out

Always, Always, Get a Solicitor. Don't offer them any information, make them tell you what they think you have done.

Are the POLICE really this bad ?

Scamera partnerships worry me sometimes, but the Police ?

There are so many "motoring crimes" commited everyday, mostly speeding, red light offences, and white line offences (just from my observations), that any copper who wanted to fill his book could do so, very easily, without having to resort to "fitting" someone up.

If things really are this bad with our Police force, perhaps we need to join the rioters !

As you can never talk your way out of a problem - the best advice is not to talk to the police whatever the circumstances.

If you haven't done anything talking to the police may get you into trouble. If you have done something let the police prove it - plenty of time to plead guilty.

Yes and no. A solicitor will make sure they don't bullst you. As pointed out, they have to tell you what evidence they have before they interview you, and a solicitor will make sure that all happens correctly.

Good advice. Never walk into a police interview without a solicitor.
