Hi folks,

I was caught speeding a month or two ago.

They allege I was doing 91mph in a 60, on the A96 Nairn to Forres road, quite a coutry road, but this area is quite a straight bit after a long sweeping corner.

I was caught by a Dark Blue Unmarked Volvo, in an Area where there is no street lights so I couldn't see them and other than my head lights he couldn't see me. They only indication that I had that they were in the area was when I was a 100 or so yards away they switched on the headlights and I thought at the time whoever it was about to pull out in front of me. This in itself almost caused an accident.
Before I braked I had just checked the speedo and it was reading between 70-80, I have been travelling at a constant speed.
I am a firm believer if you do the crime you do the time, however on this occasion I am very sceptical about how they got their reading.

I do beleive i was done by a Handheld Radar gun as it had the speed flashing in a red LED type thing on the back, I have a picture somewhere of one
Both me and my other half feel that we were going a good bit less than 91,

Where do I stand, what can I expect ??

Presumably the Officer/s stopped and reported you for speeding and also showed the reading they had obtained on the HHR.

Looks like they checked you some distance before you looked athe speedo.

Did they give you a Fixed Penalty Notice?. If so grab the procedure with both hands. You admit you were speeding.

At 91 mph, if the officers followed guidelines then, at over 85 in a 60 limit, they should report for summons and Court hearing. If this has occured then you will have to argue the point about speed at Court as Mags will be considering a ban.

No fixed Pen, Got a citation for court later this month.

Well they only had about 400 yards or so to play with as there is a long wide corner before hand. i looked at speedo before the corner and just as I exited.
between 70-80.

My girlfriend apparently looked at the speedo as soon as she saw the headlights go on.. again between 70-80 and just before i hit the brakes

As i said I admit I was speeding, just not as much as they think I was.

A minor point, but what makes you believe your speedo is in anyway accurate?

Granted, they usually read high, but still....

Yeah.. from experience with a GPS Snooper.. they nearly always read high.

And that would be a fair margin out for a **53 registered car.

My point is also the fact of the police sitting just off road and just as i'm 100 yards away switching on thier lights and pulling right up to the road.. almost caused an accident in it's own right.

also just a thought... serial number of the gun and proof it had been calibrated that day?

why would they increase the speed artificially to that level? Not trying to be funny, but that don't make huge sense to me. If they wanted to do you for speeding, they had you bang to rights, as you say....and if they wanted you banned for whatever reason, surely they'd have claimed nearer that magic ton??
