Pictures of where the accident occured as requested. There was another car parked in front of the renault, a Mercedes, which I was along side of when the incident occured. Comments would be appreciated.

assuming you're coming towards the picture...if someone managed to hit the side of your vehicle, when there is around 8 clear feet of extra width then either

a) you were both unable to judge your own width and hit each other
b) she was driving the widest Merc the world has ever seen.

The problem you have is that whether you were morally and driving wise in the right here (which I have to believe you were having seen these), if your wheels were over the centre line then you're on very sticky ground.

If Im honest I reckon your best outcome on insurance is knowck for knock here - because despite commensense telling the world to have ehr removed from driving, she can claim, legally, to have been on her bit of road doing ehr thing...

Thanks for the reply, knock for knock is what I was expecting. Unfortunate that there were no witnesses. Just waiting for a decision from the assessor as to whether repair or write off.

Well, I understood that you should give way to oncoming vehicles when there are parked vehicles on your side ... but I can't find it in HC though. I'm sure it used to be there, along with giving way to traffic coming up a hill ... but I can't find that either .
