Recieved NIP for 61 in a 40. I think it must have been a police man as I saw no flash (and definately no police car).

My worries....

1. I dunno if it was me or my ladyfriend driving.
2. The "catching device" was definately not visible (I always keep watch for cameras/police).
3. I'm in the forces and am due out to "play in the sand" for 6 months in two weeks, I would ask for photos, location etc but I will deploy before I can reply.
4. If it went to court I would not be able to attend in next 6/7 months.
5. There is no fixed penety, am I looking at 4 points here?

shall I...

1. Ignore it (I deploy 3/4 days after the 28 day period.
2. Return unsigned and ask for photos?

Any help appreciated please!!!

You could try returning it with a request for photos and giving a new address in Iraq. Don't make it too obvious its a forces address and they just might think its all too much trouble for them.

Just return it then piss off, there's no point playing games as in your job you are actually one of the easiest people to find, fine and then get an attatchment to earnings order on (you then run a risk of added shite from your CO).My advice would be fill it out properly (by all means fill it out saying you were both driving and its up to the courts to decide) then give them a covering letter saying you'll be out of country between these dates and why. You might be pleasantly suprised if you don't play games.

2 years ago my so got an NIP with the 28 day period expiring a week before he was due to go to france to work for 6 months. He just ignored the NIP and, apparently, a few more letters, presumably chase-ups, arrived at his former address and were returned with 'moved away' written on them. Nothing further happened. Now, what's interesting is that he was driving a car registered to my company. We supplied his name and London address, but they never came back to the company either. We were expecting them to, but they didn't.
Advice? Throw the NIP in the bin. They have no record of delivey and you can always say you never received one. It'll waste a bit more money for them as well!

Mel writes pearls of wisdom.

Especially if they get whiff of your Regmt. Co and Adj are not going to be pleased and may invoke S.55 Army Act (IIRC the catch all) conduct prejudicial etc.

.... and if Sar'nt Major gets whiff, wow 60 notes and 3 points is pussy food compared to his wrath.

PS I forgot... PG safe return from your hols...

Just out of curiosity, has any one received an NIP and after receiving a reminder told them that they never got it,it must have been lost in the post.
What was the outcome?

Probably a hanging for the porkie.

A NOIP is a NOIP is a NOIP and reminders are not sent. If you claim lost in post then it's your arguement at Court against them that you didn't get it, for the Act states that deemed to have been served until the contrary is proved.

Name and shame forms/Conditional Offer papers are a different matter and can be repeated.

Thanks for replys people,

Gunna ask for photos (you never know, it could have been the girlfriend), location of capture (definately not happy about not knowing I was got).

Then gunna wait and see what happens, when they reply I'll see what they say, if necessary I'll give my Iraq address as my point of contact.

I know they have to serve stuff to a court within 6 months, what happens if I'm out the country? Do they serve it and it just waits for my return?

How do I find out what I'm likely to get?

Yep.. just because they serve it doesn't mean you are in court the following day.. it could be months after that.

Cheers
