Caught doing 101 on the M4?
Discussion
I was hoping for some advice.
A friend of mine was caught speeding on the M4 doing 101 mph, he has no points on his license but is worried about getting a ban. Does anybody on here know what the courts tend to do to people in these circumstances?
Will any notes from employers help to keep his license?
Thanks
Neil.

The magistrates have the option of discretionary disqualifcation.
To survive this, the circumstances need to be favourable in these points:
1) No previous penalty points.
2) Low volume of traffic
3) quiet time of the day
4) Whether or not the police car following him was there for some time. (ie your friend not using his mirrors. Of course it could have been a camera or vascar marks and the BiB on the slip road)
5) By the same token, was the 101mph attained for a great distance/time.
6) Family circumstances
7) Work circumstances, ie: times starting work, availability of public transport etc
8) Any other factors, ie: passing junctions, roadworks etc..
I know of a 116 mph on a motorway on a motorbike and the rider got 6 penalty points and £600 fine, due to the 8 points above going in his favour..

He just told me it was on LTI 20/20 hand held camera so he recieved a NIP on the spot and now have a summons to appear before court.
Thanks again.
Neil.
Ok, so the policecar following him business is out...He'll just have to state that the speed was momentarily excessive and not prolonged.

Point 1 - Does this mean ever or currently on the license? Does the court have access to spent points?
Possibly, but if you have spent ones then just say "no points on licence" (up to them to look it up), if you have never had them say "never had any points on licence"

Hi,
My friend just pointed me here, its me whos due in court on a speeding chrage heres the details
I was caught on the M4 near chippenham in a 206 GTI by the police with a LTI 20/20.
he showed me the camera which said 101mph
I have just got a summons to appear in chiipenham magistrates.
If I lose my licence i lose my current contract which means im srewed really Ivs got a family with 2 young uns who rely on me totally.
Just wanted to know what type of mittigation i should be putting forward.
Ive got a totally clean licence, never normally speed, got a 1.6 206 cc, but on the day in question was driving my missuses GTI so not used to the power really, had a momentary lapse of concentration as we were on our way to the national modified as the missus makes clothes for MAX Power, and we were really late.
The copper was in the hard shoulder with the handheld so do not think it was prolonged reading, he waved me down and I stopped straight away

Ive been in this situation. Police said I was doing between 106 and 118. No photo, or proof. I went past when they where hid behind 2 lorries over taking at night. I saw the lights suddenly appear between the two lorries and immediatly slowed to 70 before he got to the point of being able to see me. Fair cop I was speeding.
When the statement from the police came they then changed there mind to doing 106
Went to magistrates, looked smart, appologied, pointed out that the police didnt follow me I knew I was in the wrong, said I was doing 96 and admitted so.
Pointed out that I needed the car for work, got letters of reference to say so and how good I am normally. Gave them this to read.
Clerk turned to magistrates and said, it comes to this will this make a difference to your decision they said no, I thought CRAP.
They came back and said your getting 6 pnts, 300 fine and court costs of 20.
I think I was lucky, but speaking to a magistrate I know before hand and she said best thing to do is admit fault, show remorse/appologs etc look smart not like you where in a fight the night before.
Hope this helps

Chap I work with got done for 100.7 (heart fm!!!! or at least that's what we call him now!) on the M5..
Driving the Mrs' car, got zapped from a bridge and pulled further down the road..
Ended up getting a 5 day ban, including a weekend and the day that he was in court (@ 2pm) and £160 fine..
He was a lucky boy!

I know where you're coming from and if I was a civvy, I'd do exactly the same...decent suit, sombre tie etc..
However, the scum that appear in the dock never go to such lengths...they turn up in regulation shell suit, trainers, big chains on outside of sweatshirt etc and the bloody magistrates don't bat an eyelid...
We've got too f
g tolerant in this country..we really have..
When I got there a friend drove me, wearing jeans etc, everyone else looking like they have just had that punch up, I think they all thought I was my friends solicitor.
What was funny when they said where not going to ban you, my friend almost fainted, the reporter was scribbling like mad as well.

Get a lawyer to represent you. Pricey but worth it.
My missus got done doing 56mph in a 30mph 18 months ago at the end of the M32 in Bristol going towards Temple Meads. (Before the repeater signs were added).
With 9 points already a ban was quite possible, but the brief pleaded loss of earnings, employment etc etc and she ended up with a £300 fine and 5 points which were delayed from going on to her licence until 6 came off this May.
But remember that once played that defence can't be called upon again.
