Hi,

A friend of mine has received a NIP in the post today.

The NIP is dated 12/07/04 and is referring to an alleged offence of excess speed from 03-JUN-2004.

Has this been sent out too late???

I remember reading somewhere that it has to be actioned within 14 days of the alleged offence.....

What should be done next???


Any advice gladly received.

NOIP should have been sent out for receipt before last post on 17th June, 2004.(14 clear days).

From what you say it looks as if one could have been sent to a Reg Keeper(RK), who is other than your friend. RC would then name your friend and Conditional offer sent to him. If this is the case and RK got the NOIP before 17.6.04 then law complied with and your friend is now in the Section 172 phase i.e. name driver.

If your friend is the RK, hasn't changed address of late or other circumstances that would cause SC to send out late, then it would appear proceedings cannot be taken for speed as NOIP not served in time mentioned at law.

He is the registered keeper and the letter is requesting the name and address for the driver in charge of the vehicle at time of offence.....

NOIP has to be served on RK or driver within 14 clear days of offence of speeding otherwise proceedings cannot be taken.

Now you say your friend has 172 notice to name driver which is another matter and should be complied with otherwise offence committed.

This is providing your friend resides in UK and not alongside you in Der Fatherland.
