Hello All

Hope you might be able to help. I received a NIP with date , time and location shown from Notts BiB but the speed the car was being driven at was not detailed. Is this unusual or significant as the last time I was done in 1998 (Beds police) the speed I was driving was shown.

More details will only be released on written application by the alledged offender, when known. Bearing in mind fines go up as speed increases I'm concerned as to what I will be letting mysef in for.

Thanks

It is definately unusual...but mistakes happen...recent poster had the speed change between NIP and summons.

By significant if you mean can you use it to your advantage IMHO no.

I'm sure one of the many knowledgable Bib's and legal types will confitm or correct, but I think since the NIP had been issued (and presumably within the 14 days) minor errors can be corrected and it still stands.

You are of course entitled to the evidence against you and can request the relevent video/photo if you desire.

The purpose of a NOIP is to bring to the attention of a driver that he has committed an offence and in order to refresh his memory and if necessary get legal advice/help. It generally covers the type of offences in the RT field that can be committed and driver not pulled at the time.

All the law requires is that the driver is notified of the offence alleged i.e. speeding. There is no proviso that chapter and verse should be gone into.

This case the law has been complied with re NOIP.

Just out of interest, where were you caught?

Was it the digital cameras on the ring road by any chance?

James here:

Interestingly Notts don't tell you the speed, you can ring and get the speed but they will only tell the driver.....!!!!

I just send a letter that says due to the incidence of cloned cars I am unable to reply to the NIP until I have seen copies of your photos to verify that it is in fact my car we are talking about. The photos seem to show the speed of the vehicle somewhere superimposed on the photo..

After that move to the PACE argument and there is a good chance it will all just go away!

What they do then is to send you the photos and snip the speed bit out with a pair of scissors .

They say they will only divulge the speed to the person who aknowledges that they were the driver.
