DVLA Court request!
Discussion
Hi guys, just after some advice. Very odd and stupid situation...I'll try keep it short!
Early December I find car I want to PX with mine. He currently had private plate on (B18 CFN) so waited a couple of weeks for the plate to be taken off, and original plate and documents to return. I then PX'd my car, and took the other car home...
We both sent off the respective Log books, and both received our new log books with correct plates on, and in our names as it usually works, so all is good..
Person who I px'd my car with, then puts his private plate (B18 CFN) onto his new (my old) car, and all documents come back in the right place, correct name etc..
Today, I receive a letter instructing me to go to court! In breif, it says I didn't inform them of 'change of keeper' for vehicle B18 CFN.
Now, I'm fairly thorough when buying a car, still in touch with the other guy, and we both confirm that at NO point have I ever owned a car with the plate B18 CFN on, I bought it once all documents were back in original form, and never ever saw the car on that plate. I then sold it a couple of months ago (yes, only had it for 1000 miles), and obviously at no point did the plate B18 CFN come into it, at all.
What the hell has gone on here, and what the hell do I do! The form I have with my court order just tells me where to go on the court date, or plead guilty before hand!
Over to you!

Did you get your letters to say you had informed them of sale of each respective car?
Can you get a copy of the same for the car you bought from the seller?
That is your proofs you notified them of what cars. Also, write to them, copy to relevant court asking them for copies of any documents they intend to produce, and send them copies of the documents you are going to produce in court. This probably won't be acknowledged, or acted on by DVLA, but when you go to court (yes go), you can produce this to the court and say you tried to sort this without wasting court time.
Finally, if you win, ask if the court can rule that you are compensated for your loss of earnings. Some courts have been nown to do this, although it is by no means guaranteed.

B18CFN is your old car that you "didn't inform" the DVLA about.
The new owner has gone "Where's my new logbook?" to the DVLA and as a result of that they have decided that you didn't tell them about the change of ownership, as they've had to send him a new logbook manually.
Forget about the car you swapped it for and later sold - that's nothing to do with it.
But as usual, the rules of service apply - i.e., once placed in the post, there is deemed service two days later, you've complied if you say you have unless the DVLA can advance evidence to show that you haven't. (They can't, they just say they don't know what happens).

If he was to request a new logbook from them as you say, surely he would of requested it under the standard 57 plate? He can't of put the private plate on before the standard one landed on his door step..
That, and he tells me he didn't request anything for any car!

I've been in a similar situation regarding a private plate and two BMW 525i's, one burgandy, one silver, both my cars, the burgandy one was wriiten off, the silver one was its replacement, DVLA got itself into a right pickle over which one was written off, sorn, taxed etc etc etc.
A trip to my local DVAL office, and a very patient manageress of that office, sorted it.
DVLA are a nasty organisation who threaten people and write nasty letters, some of their satff can be absolutely lovely, and will help you.

Similar situation here, too. I bought a car from the local Fiat dealership which they'd only just put up for sale. I registered it etc and got it onto the road only to receive a letter a week or two later thanking me for SORNing it. Obviously the new registration team worked faster than the SORN team! Was all sorted out over the phone with minimal hassle. I just had to keep a note of the name of the operative with whom I spoke with me in the car for about a week, in case of any Police stoppages.
