Accident advice please

Hi there, my partner had an accident the other day she was hit in the rear by a third party, Third party insurer have accepted liability and have contacted her wanting to settle the PI claim directly out of court, she has pretty bad whiplash and is currently signed of for two weeks minimum, and due to the nature of her job where she has to use restraints and physical intervention daily until she is 100% she will not be fit to work.
Should she discuss PI with the third party insurer or should she just go via her insurers solicitor.
It's not so much the compensation she's worried about, it's potential loss of earnings and physio etc. She only gets statutory sick pay in her job so is already going to be out of pocket.

Start looking at a nice holiday for the two of you, as whatever route you take your likely to get a substantial payout weather you want it or not. Speak to your own insurance co, and ask their solicitors to deal with it, will take away any worry and hassle your Mrs may have about dealing with the 3rd party insurer.

I got £3k for a fractured spine, broken fingures, permanent disability and 3 months off work. So I wouldn't be booking a holiday on the strength of a bit of whiplash.KrazyIvan said:

Quel sort de tosh. Nobody is forced to make a claim, or to accept any payment. If someone has an arguable claim, it will be settled or adjudicated upon and payment made on a scale appropriate to the injury, or settled for a commercial or nuisance value if not a clear claim. Captain Muppet said:

Wifes friend ran in to the back of another car at a roundabout at less then 5mph, the PI claim for the two occupants was a little over 18k, her insurance co settled on 12k rather then go the court. Another friend daughter got knocked of her bike while riding past a truck turning left, she suffered a broken pelvis, among other injuries and walks with a slight limp, 3 years and several court battle latter it was deemed 50% her fault, but she still got a touch over 60k in compensation. te. Injury payments are made exactly as Breadvan has stated. If you do work in the industry then you'll know that the TP insurer wants to settle at a fair rate. They will pay for rehab, they will offer you a legal costs voucher and they will do all they can to stop you incurring unnecessary legal fees that can double the cost of a claim for. O good reason.
The rest of you conspiracy theorists need to think why premiums are rising so high so fast and it's the involvement of solicitors when not needed.
