Road Rage Driver Jailed
9 months for driver who blocked path of car on the M6
A 31 year old man from Scotland has been jailed for nine months following a road rage incident in 2002.
David Hamilton was found guilty of dangerous driving and affray following an incident on the M6 near Carlisle two years ago.
Last month's trial heard that a Golf driver heading north on the M6 was boxed in by two sports cars who then proceeded to block his path when he tried to overtake.

Just goes to show there's idiots in all walks of life. I have to admit when I saw the headline I immediatley thought of some chav getting out of the car and giving some poor bloke a beating for daring to overtake him or something. But a Ferrari driver... FFS

in some ways that's even worse.Just managed to get a conviction against a bloke that lost it in a traffic cue and ended up punching me whilst I was sat in my car with my wife and kid.
It took almost a year to get him in court and sentence will be passed on the 29th July but by God it was nice to hear the magistrate return a guilty verdict. (I decided to get out of my vehicle to talk to Mr. Harris about his driving and whilst I was leaning on the side of his car my hand slipped and I fell in through his window accidentally striking him... YEAH RIGHT!)
Agression on the roads is getting out of hand - glad it's being taken seriously!

I suspect that this would have not ended in a prison sentence had the driver coughed for it to start with. To stand up in court with a "it wasnt me gov'" as a defence is a little laughable. The police and the CPS wouldnt have brought a charge if they werent 99% sure it was him.... and the jury certainly wouldnt have found him guilty if there was doubt that it definately was him....
So, he would have perjured himself with his defence. That alone is worth a prison sentence! So, a ban and a big fine (but lets face it £800 for a Ferrari owner is half a service!) would have been the normal result, but to lie like this, well the judge had only one thing he could do....
"Take him away to the cells....."
Oh, and good to hear they are taking these types of things seriously now. The roads are dangerous as it is - we need to get these morons off...

Good result Phil. If you don't mind telling us, what sentence did he get?
any money that it was an old merc and fezza though.
any does it really count as 'road rage' if he only overtook and flipped him the bird?
surely as above... being hit should be more serious.
and are we forgetting the other side of the story, the little golf could have been just as bad, a ferrari and merc racing, maybe he thought he could join in... where as maybe the merc and fez were just heading somewhere at a decent speed.

When I find out I'll let you know ... he's being sentenced on the 29th and so I can find out on the 30th what was decided.
When the Magistrates found him guilty the legal advisor trotted out a whole raft of other road rage incidents where the norm certainly appeared to be for a custodial sentence of between 3 and 9 months however the magistrate did point out two differences between the cases that were read out as examples and mine.
Firstly that the victims on the cases read out as examples had generally been quite badly beaten in the attack - I would be the first to admit that I got nothing more serious than a punch to the throat - so the magistrate made note that the attack wasn't severe even though it was still an assault.
Secondly that the other attacks had generally been the result of a longer and more drawn out incident and had therefore built up over a period of time whereas the incident where I was assaulted seemed to have just been a spur of the moment decision by the defendant and therefore the magistrate questioned the defendants emotional stability and anger management - reports have been requested and hence he doesn't get sentenced til the 29th however he has been warned that he does face a custodial sentence.

(some can/may be exceptions to this rule but very few)....... as the muckycedes is looked upon by the great unwashed for some reason as a status symbol......
Well not knowing all the facts but has know one else ever slowed someone down who has pissed you off !!! surely the guy in the merc is to blame followed by the golf driver for both driving too close to the cars in front ??? We dont know what the golf driver did to recieve this hassle just my 2 pence worth
The problem is that law courts,sentences and police evidence normally do NOT reflect what actually happened.Never been to court myself but cases of road crime I have been involved in have never ended with justice being done. Warning, do not believe what the papers say,(weapons of mass destruction?)
Hey folks could just be my views here , i understand the lying in court etc is not acceptable and deserves a custodial sentence .
From what i have read on the BBC site etc with regards this case , i cant see how this is Road Rage , dangerous driving yes totally and utterly unacceptable , if anyone has any views etc will be more than willing to listen

Hi Ross..
It was quite clearly 'Road Rage'. However, there is no such offence in law and consequently the true offence for the circumstances in question was 'Affray' (Section 3 of the Public Order Act 1986) and that is what the offender was charged with, along with dangerour driving.
