A colleague (yes, really!) has been informed that he has been recorded at 109 mph on the Toll. He was not stopped at the time but notified by post. He admits that he was speeding and is genuinely remorseful. Conditions at the time were clear with little traffic.

What is his likely punishment? I should add that he has only just joined the Company in a senior role and being without his licence could cause a few issues.

Thanks

Why is he remorseful? Clear road, good weather, his only mistake was getting caught!

Unfortunately, it won't be a fixed penalty.

This link should give him an idea of the penalties upon conviction - Magistrates' sentencing guidelines..

And was this within a 70mph section, or a 30mph / 50mph section of Toll Plaza ?

a 30mph / 50mph section of Toll Plaza ? He would need pretty awesome acceleration or mahoosive brakes to achieve 109mph in those areas !!

No he wouldn't as it covers about a mile - and I believe you can get up to similar speeds before the NSL sign after the booths wink

BTW, I received a survey from M6 Toll today, and in the 'any other comments' section I suggested banning speed camera vans & unmarked police cars.

How was he caught then, fixed camera, scamer van? Surely a traffic cop would have stopped him there and then .... or am I wrong.

They usually have a laser on one of the bridges crossing the road.

Sorry for the delay, have just seen the NIP which states amongst other things

"I have photographic evidence from an approved device"

and

"Location M42/M6 TOLL,JUNCTION 9 - 7, GANTRY 6514B / 1165B, MP41/4 SOUTHBOUND"

Hmmmm - that's where the M42 and Toll Road run together - variable speed limit territory too - I put what you quoted into Google and got links to NIPs on Peepipoo - one for doing 70 when the gantry was set to 60. Doing he speed quoted there was not a smart move I'm afraid - not the same as the "proper" bit of the toll road where the main thing will be unmarked cars or vans on bridges..

Sounds like one of those gantry mounted cameras, just before the M6 Toll merges with the M42. Doing 109mph there I'd guess the limit was probably 70, but as others have said, it's a variable limit zone, so could have been lower.

I expect he'll get a summons in about 6months, and then get a medium sized ban and medium sized fine.

Are people really still of the belief that the M6 Toll is unrestricted/unpoliced?!

If you are or ever have been employed then its ban time

If you have never been employed and its a stolen car then its 3 points in the very worst of cases

The notification by post is a NIP.

Forget to reply and it will be 6 points and a large fine - almost certainly no ban.

Reply and a ban is very likely.

You have to consider how the insurance company will rate a 'failure to notify' conviction in relation to future premiums too for the next 5 years.
