Hi Everyone
I'm after some advice please....
My Husband and I engaged the services of a local garage to act as a Broker to sell our Neismann and Bischoff Arto Motorhome. It started at £60k in April this year; in two stages reduced to only £50k. It was new when we purchased it 2.5 yrs ago and was in 'as new' condition when we put it on his forecourt. When it was returned to us today, following no joy with the latest interested party, I inspected it to find that my immaculate mattress was stained, there was broken glass on the hob, the unused oven pan which had been cellophane sealed with the instructions inside when we left it had been opened and used, an unknown saucepan was in the cupboard, bathroom filthy, loose change in the locker plus other personal belongings and bits of crisps everywhere. I called the owner who proffered no explanantion except to say that one of his cleaners had broken the hob glass and he'd replaced it. I'm devastated as not only have we not sold it, but some stranger has slept in my bed and it's put me off using it again.
Any advice will be gratefully received.

Im A Motorhome Salesman for a large dealer, we sale or return vans for customers and would never dream of using one or loaning it out to anybody, the garage is taking the piss big style!

However apart from giving him a bking I cant really see what you can do about it, you could threaten to report him to the fuzz for twoccing but you cant really prove anything, might give him a fright though!

If you are selling the van its best to stick with proper Motorhome dealers (presuming this place was a car dealer?) two good people I know in the trade are Tom at The Somerset Motorhome Centre and Rob Kirk at 3 counties Motorhomes.

Sadly for such good vans Niesmanns aren't the easiest things to find a home for privately or in the trade.

I have all sorts of possible scenarios going around in my head, sadly all ultimately involving my mattress!!! However, can anyone offer some advice regarding any action I can take against him?

OP, what would you want as the outcome? Are you looking for compensation from the dealer, if so, ask them directly.

I grilled him over the phone and he seemed somewhat suprised, possibly by my reaction more than anything else. He suggested that on of 'the lads' may have been usin it whilst on the forecourt...doesn't explain the stains on the mattress though

Send an invoice for the work required to bring it back to condition, whilst it was in their care.

what for, sounds like trespass to me which is a civil matter.

You can sue for tort (damages) but i would get a quote for new bed, full valet etc and get a solicter to write a letter for you.

I was interested in a topic on here from 2010 which suggested that if a garage used a vehicle beyond owners consent then they were preventing them from enjoying it in the condition in which they entrusted it to them...

I can't help with advice, but I assume you must feel awful. I'd feel like someone had invaded my personal space, I'm a bit shocked.

Good luck smile

You probably don't want to know what went on on the back seat of your Lexus before you bought it, then wink
