Hi guys,

Looking for a bit of help with this. I sold something on eBay and the buyer claimed it was damaged when it arrived. I offered a refund when the item was returned.

The item arrived in the post this morning but it's different to the item he was sold. He is adamant that he sent back the item he was sold and has told me to stop messing him about.

The item is a Mk3 Fiesta Clock and was only a tenner so I'm considering just refunding him to save myself a lot of hassle.

The clock I sold to him had a light green screen, whereas the item he sent back had a black screen. I have asked him to explain this and he told me to stop messing him about and send him a refund. I should probably also point out that he left me negative feedback before even getting in touch with me.

If he's already left you negative feedback then you've nothing to lose.

Stick to your guns.

Did your original advert show the item with the green screen ?

You could take a photo of the clock with the black screen and send this to the eBay disputes team , outlining the problem .

At this stage you have nothing to lose and everything to gain .

The original advert showed the item with the green screen. I'll send the pictures to the eBay dispute team and see what they say.

So, it would seem the guy needed a clock to replace the broken one in his car, bought yours and now trying to back the broken one to you for a refund, charming.
What feedback does the buyer have? Check it and see what other people have said about transactions with him.

His feedback seems alright. I made the mistake of leaving him feedback as soon as he paid, therefore ended up giving him good feedback which he really didn't deserve.

Makes no odds really as you cant leave negative feedback for a buyer anyway, and leaving a 'false positive' would mean your feedback could be removed anyway.

You need to call Paypal, show them photographic proof that he has swapped the clocks. I'd go for him just as a matter of principal.

a friend of mine had similar. he sold a manifold, turbo and downpipe together, and the bloke returned just a turbo, which clearly wasnt the same one. he complained to ebay/paypal and they sided with him (seller) very quickly, removed any feedback and told the buyer to stick it

If you can prove it was a different one - and a picture with a different light would be pretty conclusive!! Then I'd be requiring Ebay to sort it out AND permit you to leave bad feedback to protect other sellers from what is fraud.

Good luck with the Ebay/Paypal disputes team. I sold an Ipod nano and had a similar issue with the buyer telling me there was a fault so I requested the return of the item for a refund to be made. The Ipod I received back was quite severely damaged with what looked like a screwdriver (scratches & dents on the rear). I supplied images to Paypal and the buyer was still refunded in full and I received the negative feedback as an added bonus!!!
Personally I would contact the buyer and advise him of the fact you have images etc. and you are going to contact the police as this is in fact a criminal act.

And this is just one of the reasons why Ebay is now dross!

Brilliant idea, such a shame that the world is full of cocks!

You could, but it would be reasonably easy to prove who it was and have all your ID's banned from eBay. Seller would also get his stars reinstated. If you have any sense you keep your selling and buying ID's as 2 completely separate entities to avoid this sort of thing.

If you're selling parts, get a UV reactive pen and mark them in multiple places before selling them. State in the auction that all parts are security marked and you'll find this sort of thing will stop.

That has to be the funniest posts on an ebay thread I have read.

Why do you think they removed this facility in the 1st place?

I've spoken to one of the eBay live help chat things and they said they will get back to me. I will then, presumably, be able to send them the pictures.

A lot of the time you get more resolution by phoning them and talking to them. Out of interest, did he return the clocks via trackable means? If not then you could have denied ever receiving them. Naughty though.

That wasn't a mistake, that's what you were supposed to do smile You weren't supposed to know the guy was a thieving tool, most buyers aren't like that thankfully.

As others have said, make first strike (assuming he hasn't already opened a case) and contact eBay explaining the situation and sending photos. They will email the buyer for an explanation. Assuming he bothers to respond at all, he's probably a bad liar...

As above. Contact eBay -- they have a team that investigates buyer behaviour. This is becoming easier later this year with a report button to report behaviour like this for investigation, but at the moment you need to go through customer services.

This might be a mistake on his part or an attempt at fraud. You need to be careful accusing him of the latter if it might be the former. One of those is a crime of dishonesty and suggesting it is a defamation. Either way - he hasn't returned the item that he wants refunded. You should ask for it to be returned if he wants a refund.

The other item you should keep with all the care that you would if it were your own.

Was it sent to you tracked? If not then he's stuffed in terms of forcing a refund from eBay who will require proof of delivery. If it was tracked then eBay will refund him automatically and you will need to reopen the case -- one of the reasons is that the item isn't returned.

eBay is a spectacular martketplace and this sort of thing is relatively rare, although it does help to know your way around or do your sales through someone who does.

Good luck.
