Hello everyone.
ive been scanning this forum a a couple of months and find some of the topics very interesting. so i have finally decided to post my first topic.

basically i want to see where i stand in this situation.

i went out to my car early this morning to go to work and i could smell something burning near-by( a garden fire) and i had found the my car was covered in ashes from this fire. it was absolutely caked in ash(mainly because it was lightly raining as well. when i came home form work i tried to wash it off. but when my car dried the paintwork is damaged and not all of the marks have come off.

i posted it here because i want to know where i stand legally( my dad phoned the police they are coming out today to look at it)

so can i have the opinions of the BiB on here

Could be classed as criminal damage, as the offenders can be 'reckless' as to damage that may have been caused.
I.e. Ashes landing on the car.

It is stretching it a bit, and obviously I can't comment on the damage or situation as I haven't seen it, but hopefully the bib attending to take a look will give you the info you need.

unfortunately the police said that it is a matter they cannot deal with and to contact the environment agency. so my dad will getting in contact with them on monday. thanks a lot guys. can we have any opinions from the BiB. ill post some pics ive taken of mine and my mums car.

Silverbackmike, my cousin Bib is right in that the only offence could be Criminal Damage as the person was reckless in what he did. (you have to be either intentional or reckless to commit the offence, you see)

IMO, it's a civil matter, the Crown Prosecution Service wouldn't touch it with a burnt barge pole.

Hope all works out well for you though...

why not have a word with the offending neighbour and try to sort it amicably before involving expensive legal teams etc?

Have you tried using a clay bar to remove the marks, they're very good and might save you a load of hassle.
