I've been a silly pillock - did 49 in a 30 zone.... It was on a dual carriage way 40mph that went into a 30 zone

I've had a license for 22 years and never had any points



What will be my punishment??

Probably just an SP30 on your licence along with three points and a £60 fine. I did a very similar thing a few years ago and thats all I got.

49mph in a 30mph limit is the recommended upper limit for the matter to be dealt with by way of Fixed Penalty - 3 points and £60.

Maybe.

Range is fine up to £1k, but probably more like £250-450 (average income) plus either 4-6 points or a 7-28 day ban.

Really? I thought the upper limit for an FPN was 40 in a 30 zone?

At 42mph, the 'limit' for SACs is higher than that.

ACPO FPN recommendations are for up to (and including) 49mph in a 30mph limit, and limit plus 25mph in 40-70 limits.

I wouldn't have thought so, it will also depend on the area to a degree.

I know Worcester have lesser fines that Straford on avon. Both me and my sister got done on the same weekend.

I was 78 in a 60 in Worcestershire and took the driving course at £60 same as the fine would have cost and therefore no points.

Sister took the course at £80 because she was in a different county.

I take it the note through the door, is a letter telling you they intend to prosecute for the offence off....

In which case assuming you plead guilty, dress nicely, say sorry lots, and point out how much of a good driver you have been for the last 22 years and how this was very out of character for you, you'll be looking a 4 points and a few hundred beer tokens (£250)I reckon. I wouldn't loose too much sleep over it.

It means you won't get done for totting up at this point.
But no, doesn't count for anything really because everyone has a clean license when they're 'done' for the first time.

Yes, they intend to prosecute. It was asking if I was the driver... £1,000 and 6 points if I didn't respond, so surely if I respond, the punishment will be less....

Do they take into consideration location and time? It was 9pm on a dual carriageway with different speed limits...

Just messaged an old school mate who's in Salford Police; don't know why I didn't think of him before... - the offense was in the Greater Manchester area.


He's had a chat with someone in the traffic dept - they've said 3 points and a £60 fine...

Do they do driver awareness courses in your area, you can pay the £80/£90 and avoid the fine/points if they do, although 49 in a 30 is usually more than they allow for this as far as I recall.

Anything about this on the letter? smile

That's odd in two ways: it's some way over even the latest guidelines for a course (limit + 10% + 9MPH) and the price of the course is lower than usual.

Well, the £60 is a penalty, not a fine - it's an important distinction as only a court can fine you.

Annoying as they are (I've had two) fixed penalties are not a big deal as long as you don't average more than one per year.
