Accident Question
Discussion
Something I just read on another board got me thinking, lets just say for arguments sake you were involved in an accident on a 40mph road and you were doing around 55 - 60mph. Police attend and ask you your speed, if nobody was injured would it be better to not disclose speed until your soliciter attends? Just thinking they wouldnt go to any extreme length for a small accident. Or would that be stupid and they find out?
Firstly you, as blameworthy, will be a unlucky man if Plod attends a non injury accident and deals with it other than an exchange of details exercise.
If it is thought you would be done for speeding on admission only, forget it, as for that offence corroboration is required. Bear in mind however corroboration can come from braked wheel marks left at the scene.
In relation to "due care offence" if a single vehicle prang is involved then "re ipsa loquitur" could apply -the absence of any explanation by the driver if the only conclusion which it is possible to draw is that he was negligent or had departed from the standard of a normal prudent driver.
Likewise for a two or more car involvement, evidence from witnesses can build up a due care offence. In your admission of excess of speed this would help to nail the lid down. A denial of this fact may, from the evidence of the witnesses,not help to substantiate a truthful account from your perspective.
Moral of all this is - engage brain before opening mouth.

I think you'd be very (un)lucky to have Plod attend a non injury accident at all.... From experience West Midlands Police wouldn't send anyone even when requested....
Hi Stepej,
That is the policy of many police forces nowadays. Simple knock for knock accidents, even where you believe someone is at fault (and in my experience, someone is always at fault
)
The extreme workload on police officers nowadays, means that minor accidents are dealt with by the drivers exchanging details and the insurance firms dealing....

I appreciate what you are saying, but I don't consider an incapacitated vehicle blocking the inside lane of a busy dual carriageway 20m beyond a roundabout a minor accident.
If nothing else it was a danger to the vehicles flying round the roundabout and having to swerve to avoid the wreckage.
I think if such a thing should happen again i'll 'need' an ambulance...

Stepej;
Here's your very own ambulance for future incidents:
The circumstances you describe, ie a vehicle blocking a lane, does require police attendance and if they haven't attended, you need to get an explanation why. I presume that the person who made the telephone call to the police actually said a lane is blocked. If they didn't then..........
