Since I am a new user, I can't post in S,P&L. Could a mod please move it there?

Didn't want my first post to be like this, but oh well.

Last night I was stopped for doing 90-96mph with an average of 95. I gave lots of remorse and admitted I was going over the limit and that it was a silly thing to do. He still gave me a ticket.

He said under the old rules it would be a FPN, 3 points and £60 fine, but under the new rules it would go to some prosecution thing and they will decide. So it could either be a FPN or could end up in court.

Could anyone help as to what the penalty might be?

I have no motoring convictions, clean licence but I am still (just, passed Jan 2011) within the 2 years of holding a licence, so 6 points = licence gone.

I have no criminal record, this is the first time ever i've even been in trouble with the police.

Reading up on websites, the all use the old info, under 96 is FPN, over 96 is court. So they are not much use.

You'll either get 3 points and fine or you'll get up to 5 points in court. 3 points isn't a biggy, 5 will molest your insurance, I can't see them going in with 6 points and a ban. Fingers crossed

They usually chuck the court threat in to scare people - It'll prob be a FPN and 3 points

While he was writing out the ticket he asked if I had any points, I replied with no. He said, watch your speed, you can't afford to be caught again. This bit made me think that it wouldn't result in 6 points.

I'm hoping the date and time will help me a little. It was sunday night at 10.45pm.

Thanks for the replies, and keep 'em coming to re-assure me haha, i've been bricking it for the past 12 hours. If it's 3 points and £60, i'll take it on the chin and learn from it. I really don't want to end up in court.

Yeah I had the old "that'll be 6 points on your license" once - didn;t even get 3 points as they had no evidence ( was supposed to be a speeding offence but th officer was off duty) - I realise your situation is different as there is presumably evidence but I always thought you get 6 for things like dangerous driving or driving without due care etc - simple speeding offence is different unless its over 100mph - of course, I could be wrong though

Over 90 and I think you'll find your self up in court. It happened to me. 96mph... I was asked by the Judge if I had any leave due and I said three weeks and I got a 3 week ban...

I got 3 points and 60 quid fine for 101mph on the A1m. Got a sp 50 but just got a ticket no court or anything. That was 2001. Got the same for 97mph on a dual carriageway about 6 months prior. Never been done since so was quite lucky imo.

If it gets to court - 4 to 6 points (or a short ban); a fine equivalent to about 1 week's nett earnings; court costs of maybe £60-£80; Victim Support Surcharge of £15.

An early guilty plea would qualify for a discount of up to 1/3 from any fine imposed.

I'm a full time student, but work part time. I don't mind a large fine and 4 points. For insurance reasons, I do not want a ban or 6 points.

I wouldn't worry too much. I was clocked at 97.4 mph down the M3 and was given 3 points and a £60 fine.

No biggie.

One of my best mates was followed by undercovers doing 98 on the motorway and and driving too close to cars infront and flashing to get them to move out the way, they told him at the time he would likely receive 6 points and a fine. He then got a court summons through the door charging him with Dangerous driving which was later reduced to Careless driving and he had his boss call them and say he needed his license for work so he ended up with 10 points and a £300 fine.

Check out the insurance comparison webites - sometimes a short ban works out better than points.

Why would you feel the need to drive at those kind of speeds (in a non-emergency?). I thought 80mph was the unofficial '70' on motorways so don't really understand why someone would risk going that much over the limit. Not criticising here, but trying to understand the thought process/logic.

A ban is NEVER a good idea.

People who are banned have to explain it for their entire lives, and especially if they wish to live abroad.

Pay the fine, take it on the chin and SLOW DOWN. Join the IAM or RoSPA & learn to drive properly fast on the road.

Not sure what context you mean 'properly fast' on the road here - are you suggesting it is ok to speed if you have been taught to do so safely?

you will get 3 points probably, not a ban. I was caught doing 96 in a 40 zone (it was fields on either side, no other road users, clear visibility), Yes it was silly and lesson learned.

Got stopped and said I am sorry I was going too fast, Got to court, turned up sharp, on time, said I was very sorry there is no excuse, I realize how how valuable my license is to me and how I should be more careful as I am not just putting my own life at risk but others too. I got 6 points and a 200 pounds fine.

That's a totally different set of circumstances to just doing 98!

(In fairness I can see you're not trying to defend him).

10:45 on a Sunday night on a quiet motorway. I may well get lynched by the PH moral Police but I'd more than likely be sitting at 90mph or so aswell, and I'm sure I'm not the only one.
