To loud!!!!!!!

on sunday, while coasting back to my house, i got with in 200 yards only to get pulled over and given an on the spot fine for "causing excesive noise" £30 isnt gonna break the bank but i still cant get my head round it. my tiger has passed the MOT and never considered it to be to loud. is it just a case of "young man, fast car"??????
not sure about this but can't BiB give a fixed penalty notice if they judge a car to be too loud without any scientific proof? Same way that BiB can hand out a speeding ticket if they believe a car was over the limit even without a measurement devive (vascar etc). They are treated as expert witnesses in court. Might be wrong though
Not sure how a car can be TOO loud. In the same way that skirts can't be too short and beer can never be too cheap

Whack it up on the motorways or whatever but it has no place in a town / residential area. If its zorst noise on a MoT and legal car then im a bit perturbed...

I'd go as far as telling them to get stuffed if that was the case!
Two areas of the law - MV Con and Use Regs 1986 involved here it seems.
Reg 55 which deals with noise limits/sound levels of a m veh which should not be exceeded and evidence to prove this offence would have to come from a Sound Level Meter operated by BiB/VOSA guy.
The catch all one is at Reg 97 which states no vehicle shall be used on a road in such manner as to cause any excessive noise which could have been avoided by the exercise of reasonable care on the part of the driver.
This will be the one where BiB will give his opinion/ judgement and also it is the one that has been used successfully for the deaf Chavs on the front of South Coast resorts.

Surely you pre-empt reg 97 by putting car through the SVA thus making it not applicable (unless the car has been modified since). Similarly, if you build a kit tot he spec and instructions provided then you have indeed takn all the precautionary steps necessary?!

SVA which now must be obtained by all single make vehicles HAS a section for noise emissions from the exhaust. In order to pass SVA a vehicle must pass this requirement.
Unless RP's tiger was built before the SVA test became a requirement by Law, or unless its had its exhaust recently changed then showing the SVA certificate at any station should see the fine cancelled shouldn't it?
I think this is very harsh and as said earlier its officers like this that destroy the good work that other officers try to do. I'm glad this plod has never heard my Cerb
Surely the paragraph you have just quoted is purely down to individual interpretation at the time and in the circumstances. For example the same car down a row of terrace houses where the sound wave can reverberate of the buildings at 1am would be considered a nuisance. However the same car out in the open down a country lane nothing for miles, at full chat?. This rule is to vague and needs at minimum the rules of SVA applying in order for a real and proper assessment to be made. Just my tupence worth.

Sure I accept that (unless the kit car is bike-engined and needs the low gear to keep moving).
My point was more along the lines of what is and what isn't 'reasonable care as per: "excessive noise which could have been avoided by the exercise of reasonable care on the part of the driver".
Loud stereo, yes, you have a volume knob, but if it's an exhaust (being driven sensibly) that has passed SVA/is standard kit part, what more can you do to 'exercise reasonable care'?
