Speeding and being pulled

Not me, I hasten to add, I'm watching motorway police. They have followed a car doing the speed limit....it starts going faster....they then pull it at 101mph
He now needs to go to court. Far enough he was speeding, so deserves to get fined. But surely the police have a duty of care to pull him over at 80mph, or even 89mph. Before you go over 90, let alone over 100
They were in an unmarked car...so it wasn't obvious to the driver.
Is this fair? Could you get out of this??

Many many years ago now I was doing a bit of moonlighting for my prospective FIL's friend whilst on leave from the Army. It was driving a tipper truck for a demolition company. Any way to cut a long story short whilst carrying a load to the local tip in Bournemouth some ceiling lathes blew of the load despite a net being used.
I was stopped by a Police car and the Officer said " I have been following you for 3 miles and you have had bits blowing off all the way". I asked him why he had not stopped me sooner then but he just shrugged and reported me for the offence of insecure load. I pleaded guilty by post and received a £5 fine.
My FIL's friend never gave me the £5 so it was all part of the learning curve and I accepted it as my fault - no other choice really and who said life is fair?.

He was guilty of breaking the speed limit without being observant enough to notice he was being followed by the police.
I think (but not sure) the police generally follow a car for a few miles on the motorway.
This way they can ignore a bit if accidental speed creep on a driver who goes back down to a reasonable speed.
It also gives them proof against a defence based on arguing a momentary increase of speed.. Sort of thing.

That's what they do. It's their job.Nobody forced the driver of the car doing 101mph to speed. It was that driver's choice.

That's what happens when you speed at over 100mph in lots of places and get caught doing it.It was his choice to do so, he ran the risk and got caught.

It's up to the police to define how best they police the roads.They may not even have pulled him over or started recording his speed if he was only speeding by a smaller amount - say 80mph.
They may have started recording his speed for the purposes of enforcement once he started taking the piss, at say 90mph.
He may have been actually doing 90mph to 110mph and they clocked him at an average of 101mph over a distance of a mile or so.

Hopefully not. Sounds like he was speeding and got caught.I've zero sympathy for him.
By the way - I was caught doing 96mph on a motorway just over a year ago in similar circumstances.
I didn't try to argue my way out of it, it was my choice to speed.
The police involved treated me with respect and I did my best to make their job no harder than it already is. They deal with enough tools.

That's what they do. It's their job.Nobody forced the driver of the car doing 101mph to speed. It was that driver's choice.

I understand what you are saying...and yes I have been pulled for similar speeds, held my hands up and spoke to the police officer with the respect he was due. He was just doing his job, and I was travelling at that speed for a good length of time.
However in this instance I dont think the deal is fair. The police officer isnt there to make up the law....he is there to uphold the law. In the same way if you are out in the town...giving some a friendly slap or a punch or a kick, or if a knife is pulled...which is the one that gets you arrested?? All should be the case because you have broken the law! So if you are speeding at 80 then you are speeding. Therefore the officer has a duty of care to both you and the members of public around you to pull you over and speak to you.
I also think, on a different note, that police drivers should be able to disable the runaway drivers, either that or back off. I dont see how following a car driver hell bent on escaping at speeds of in excess of 80mph in a 30 zone is in anyway helpful. The police drivers are trained...the idiots running away are far from trained, and whats worse are scared! If the police helicopter is following...why not just hang back? wait until they stop then grab them. The only justification is that at least the blue lights are giving people prior warning some idiot is coming towards them.
Personally wait until the person is in a safe place and disable the car...fit bull bars to our police cars and ram the f*ckers!

They were probably conducting a following check using Provida,which,depending on tne type of check,will involve following for a distance.During which time,the speeds may have crept up,hence the final average.
In relation to pursuits-there are quite rigid policies in place,but which vary across force areas.All should involve the use of the helicopter as well as other methods, in order to safely bring any pursuit to a safe conclusion but preferably by not starting one,by the use of pre-pursuit tactics.
If a pursuit is deemed too unsafe due to a variety of reasons ,then it can be abandoned by a) the ground commander b) Pursuit controller/supervisor etc...
The role of a ground commander is a difficult one,involving split second decision making on behalf of the officer and also trying to safely pre-empt every other variable as best they can,to safely conclude what can,I would imagine to be, a horrible situation.

No problem then, I'm going to start sticking people on for 71mph on the motorway, as I wouldn't want them to go any faster and end up with a thread on piston heads.However in this instance I dont think the deal is fair.
