HELP NEEDED - DVLA MESS UP - REVOKED LICENSE - URGENT!!!!
Discussion
Hi there everyone, I am new here and saw this seemed the best forum online to ask for advice.....
Ok so I was convicted of speeding earlier in there year. I was convicted of 3 penalty points.
DVLA wrote to me whilst I was away in Spain (my mum was house sitting and opened letter and phoned me). I contacted DVLA saying I was away and they said that was fine and extended the time I needed to return my license to them to endorsed until 21ST DEC.
On my return to the UK i posted off both parts of my license to DVLA, recorded delivery and they arrived with them and was signed for on 20TH DEC, so within the time period they gave me.
On 21ST DEC a letter was generated and posted to me that I did not get until the 28TH DEC saying that as I had not returned my license it was now revoked from 24TH DEC. So the letter arrived with me in the post 4 days after my license was revoked. The letter stated that to get this lifted I had to apply for a new license. I rang them to do this on 28TH DEC and was told that because it was after the date of revocation on 24TH DEC I couldnt do it. So thanks DVLA for telling me this was happening before it happened instead of after tut.
Anyway after speaking to 10 different rude DVLA people one after the other all they would tell me is that: even though the license may have arrived in time (it did) there is an up to a 3 week wait period for them to open the envelope and acknowledge it. It didnt say anywhere on the letter that asked for me to return my license that within these 28 days please be aware there is up to a 3 week period so advisable to send it back within 1 week allowing time for this..... sounds like a load of tosh to me. They asked for it back by 21ST DEC, they recieved it on 20TH DEC so i did what was required of me.
Anyway I was told I would now have to wait for them to acknowledge my license is with them before they can lift the revocation and until then I couldnt drive.....
BALLS TO THAT...
Off to the local dvla office who were very helpful and said that I would have to complete a D1 fr a new license and if i did that they would give me a cover note saying they reieved an application for a license and couldnt see any reason I couldnt drive...... DVLA Swansea never mentioned this...
So i rang swansea and told them what i had been told and the lady said that if i completed a D1 and posted it to them recorded delivery and I knew the application i just completed was correct then I could drive up tto 28 days under Section 88 of the Road Traffic Act.
Still didnt like the sound of this as first i was told of this, everyone else was adament i couldnt drive till they opened my envelope.
So went back to dvla local office and between them and someone at swansea I completed a D1 and handed it in there and then and was produced a receipt and was told i could drive under Section 88.
Personally i now dont know what to believe, is this information correct, can i drive?
HELP!!!!!!!!!!!!!!!!!!!
thank you in advance
