Hi all,

1st id like to say hello, im along time lurker but 1st time poster. Big petrol head though!

Now the advise im after is as follows... a mate of mine about a month ago decided to sell his Showgun and found a lovely X5 to replace it with. It was brought from a garage chain called censored. The censored branch to be precise. Now on my mates Showgun had his private plate so he obviously wanted to transfer it over to the new car. The garage agreed this could be done providing the costs were paid by my mate. He wrote a check for £80 and paid the extra he needed to for the X5.

This X5 was advertised as a 1 owner car, with 12 months tax and test. The car developed a knocking noise on the front so he took the car back to be checked. It was nothing other than a bush so that was done and he got the car back. He then looked at the MOT cert and the car is only MOT'd until Feb 2012. Not the 1 year as stated in the for sale add. The other problem was that the car was advertised with full history, and that the car would be serviced before he received it. It was due an inspection 1, but all that was done was just an oil and filter. My mate notice this when it eventually got the service book that had been lost. He obviously wanted the car to be up to date so wanted the inspection 1 done. They did this and then hit him with a £150 quid bill! This was for air filter, pollen filters and fuel filter! Talk about being ripped off!

Now a month on and he's still not received a log book, and the car is still not in his name. He's called the DVLA and asked if they have received any paperwork for either car. They have not. He checked his bank and the £80 has been taken by the garage. He's now worried as he handed in his V5 from the Showgun and has nothing for the X5. Not even a receipt or the green slip to prove he's brought this new car as he was told the whole v5 needed to be sent off.

The other problem is as soon as he paid his deposit the add was taken off the website so no proof of it being advertised as a 1 owner motor (Still unsure as not seen the V5) or that it will be sold with 12months T&T, not even a HPI report. I've told him he's been a lot naive but the problem is now every time he calls the garage the lad who he dealt with is busy or not in the garage. He has spoken with another bloke who has said it was sent to the Shrewsbury DLVA office but they have no record of it either.

I've had a Google and the reviews of this chain are terrible and he's now understandably worried.

My question is what can he do?

Is this a trading standards issue, should he call the police, or get the lads with baseball bats?!!

Any advise would be greatly appreciated.

Thanks Stu

Both v5s will have gone off for the plate transfer..he wont get one for the X5 until the transfer has been complete. A HPI now will confirm the amount of owners, a google of the reg may find the old advert cached..

There are web sites out there that archive all other web site contents so it may be possible to find a copy of the ad.

How can someone who has even once seen a Shogun call it a Showgun? FFS, there's a spelling clue right there on the car.

Spelling ranties apart, OP, your "friend" has indeed been very naive. He should set out his complaint in writing (but, take this the right way, OP, get some help with the language before sending the letter). Or call round, but be polite and firm, not shouty. This is not a police matter, but the "friend" might ultimately have a civil claim against the seller, for a modest amount of damages for misrepresentation as to MOT and servicing. It is better, however, to negotiate than to sue.

BTW, I suspect that you mean February 2013, as otherwise your "friend" is driving around with an expired MOT certificate.

In future, obtain a receipt and the V5 new keeper slip.
