Hi All,

I returned to my car after picking up a load of wood flooring and I had a pcn on my windscreen, however they have detailed my volkswagen as a vauxhall.

Can I dispute/appeal the PCN as invalid on the grounds of the mistake on the document or do I need to argue the toss on the grounds of the loading/unloading rule.

It was single yellow line and I was observed at 14:59 and I returned to car at 15:08.

Any advise welcome

Thanks

put on pepipoo. sometimes the council may have the wrong info on it, so the bods on there need to see everything you have been giving BUT, with all the personal details erased, not on the original but on the file you are going to upload.
There couls also be a legal 'get out' with the loading etc ,but they are the ones to have ad with, and its free!!

however i state the above from only being an interested reader of these PCN and not as a customer

i got a parking ticket which had the colour down as gold when it was green, i tried to contest it based on the fact i don't have a gold car, they told me to jog on

sorry to hear that ging.
But colour slightly differs from Make.

Below is an official quote, note that this mentions incorrect colour does NOT invalidate but does not mention incorrect make so it infers that it will invalidate the pcn.

10: Make and Colour - The vehicle make and colour as believed by the Civil enforcement officer. An incorrect colour does not invalidate a PCN due to the possibility of poor lighting or ambiguous vehicle colours

There was no mention of the colour not being a reason to invalidate on my ticket at the time, maybe i helped get that added
I can't imagine that the model would be any different, or you could expect to avoid parking tickets by debadging or miss badging your car in some cases

1. The make mistake will be ignored. There's probably a photo anyway.
In general 'technicalities' are ignored or corrected in UK courts.

2. Afaik, the loading exception is only for delivery drivers, not private cars.

The Regulations covering parking stipulate what has to be included on the PCN.

Make of car is not one of these so the ticket is lawful.

As to loading you will need to see if the NO Waiting Restriction Order held by the LA
permitted what you did or not.

I think you've answered your own question. It says 'as believed' - I read that as a get out, in effect it's not legally binding. In other words if the officer is wrong then the PCN is still valid.

Otherwise I could stick Mazda badges on my BMW and avoid parking tickets! I'd imagine it's there to cover rare, custom built and kit cars too.

It's not the language I learned at home and school. However, consider that the poster might be: (a) a foreigner; (b) from an immigrant family; (c) a product of the current schooling system; (d) ignorant; (e) some combination of the above; (f) having a laugh at our expense.

I thought I would just update you all and state that this morning I had a letter from Plymouth City Council that they have cancelled my PCN after I appealed on the grounds of wrong make of car on an official document as above.
I may have had a lenient person dealing with my case but at the very least its a precedent, certainly within Plymouth council.

Its the little victories in life that count smile
