On the 2nd of January, I was rear ended during evening rush on a dual carriageway. I then took my case to independent claims management company which is local to me as I didn't want to pay my excess and also wanted someone to deal my case from start to end. My case was referred to 'Select Car Repair Centre' in Preston who provided me with a hire car as well as storage for my vehicle. My vehicle was delivered by a driver from their firm who drove my vehicle back to their base in Preston which at the time I was rather surprised as I had expected it to be recovered by a truck. Directline, the 3rd party insurers had also taken their time coming out and inspecting my vehicle which didn't take place until the 28th of January. I then had a call from select saying that the claim has been passed to their claims validation team as they wanted to verify some details of the claim as well as with their client. I at the time was surprised as this has never happened to me and was rather lost.

Select had then advised me to report the claim to my insurers which are budget (axa insurance). Now here is where the big problem comes in!!! Budget sent me out paperwork which I had receieved through the post with my correct details including name, address , date of birth etc however their contact number was incorrect. The policy was purchased by me from them over the phone and now when I've tried to report the claim, I can't get through the data protection as apparently the only thing correct was my name!! As you can imagine, at this point I was really annoyed and I needed some advice so I flagged a police car over which I must admit helped me ALOT! He did a PNC check for me on my reg which revealed my insurance address was in GLASGOW!!! I live in effing Leicestershire! I also got the officer to get me my policy number for axa and a contact number. I showed him all the documents I had recieved from budget and he was explaining to the otherside of the police phone to the person about the paperwork. The policeman explained he didn't know what had happened but the most important of all, I was insured. I explained that I need the DOB of the policy or else I can't get access to it on the phone when reporting a claim. He said he couldn't see the DOB and couldn't access it.

I explained to select what had happened to my insurance and the details on my documents were different to the insurance database details. They wasn't interesting and kept telling me to report the claim to my insurers so they can get their storage money and hire charges. I don't understand this, DIRECTLINE have accepted liability and are just making further enquiries into the claim before they make any offers so why is select asking me to pay their charges! Furthermore they advised me they would be taking their hire car back and returning my vehicle. Last week on wednesday, I had a call at around 2:30pm from a driver from select saying that he is about 30mins away and is here to collect the hire vehicle so I asked have you got my S3 which he didn't know anything about. I then rang select and said wait whats going on, you said you were going to return my vehicle back on the same day you collect the hire vehicle so I wouldn't be left without a car. Guy called Jordan promised me that my car would be put on a transporter from tomorrow which was thursday and that we would do the exchange then.

At half 5 vehicle goes missing from outside my house, I was in shock! I was thinking what a time for the vehicle to go stolen as its due to go tomorrow. I had so many thoughts running through my head as what if they don't believe me as its gone missing day before etc. Police came out and said to me that the hire company rang and said they took the vehicle. The police were disgusted! How could they come and take the car like that! Well they said no crime has been committed as they've took their property and if they don't return my vehicle back by end of tomorrow(thursday) then I can report it stolen and they would have it bought back to me.

Next day I've rang select and spoke to them in rage explaining how could they have took their vehicle back like this and I dont really care but i JUST WANT MY CAR BACK!. They then say they can't return my car back at this moment as I owe them the storage charges, vehicle hire charges and the key for the courtesy car before they can look into returning it. So many thoughts are racing through my head! My parents are old and don't work. I work and provide for my family and after all this i've been in tears and I really don't know what to do. I've rang the police and explained to them also what the officer in the police car has said but unfortuanetly, the lady on the phone explained that it is a civil matter and they do not get involved.

I haven't been to work since last wednesday and I don't know what to do. I've been advised by a few mates that I could go up to preston and try getting the car even with force as its my property and police wouldn't do anything as its a civil matter. What can I do? I'm really stuck on this one frown. I'm 21, I've dropped out of education 2 years ago as I needed to work to provide for my family and no-one else seems to help me or advise me what I can do. I'm sorry for the long post but any help would be much appreciated.

You took the benefit of a credit hire vehicle.

There would have been a written contract stating that you are ultimately responsible for those hire charges.

I presume you read and signed that contract.

You're stuck with it unless they make a recovery from Directline.

I didn't sign any credit hire agreement. Only thing I signed was the checklist of the hire car (any defects on car i.e scratches etc)

Always be careful about these credit hire charges. Some of the 'better' non fault accident management companies have and insurance policy in force to actually means that you will not be liable for any hire costs if not recoverable.

This maybe too little to late but should pan out alright, the hire company will likely except settlement less than what they were initially asking

PNC showing insured address? New one on me but maybe one of the resident BiB can confirm. Sure you don't mean registered address? The whole thing about stopping a police car and them being willing to do a PNC check on a your car seems rather dubious to me.

This whole tale doesn't make much sense. You need to establish exactly what's happening and why. Personally I would stop phoning people and getting told this, that and the other and start writing letters to the relevant companies getting them to explain exactly what the situation is in writing. The only reason I can see the claims management company acting like this is if the 3rd party insurers have denied it being a fault claim and are after going 50/50 or saying it was your fault.

Claims management companies will get their money somehow, they don't care if it's from the other drivers insurers, your insurance company or you.
No help now I know, but the first thing you should have done was contact your own insurers, you have to declare the accident at renewal anyway regardless of fault and once they knew about it you would then have had the choice of using a claims management company or not.

What does your paperwork from the "independent claims management" company say?

No help now - but if you had just done the correct/sensible thing at the time, i.e. use your insurance company, you wouldn't be in this position.

I hope that I am wrong, but I reckon this could end up costing you a lot more than just your excess.

What paperwork did you sign with the claims management agency?

In any case, you need to get your details sorted out with your insurance company ASAP. Don't ring the claims line, they'll have another number for personal details, and you need to talk to them first.

Select are asking you to pay their charges because as far as they can tell there is no valid insurance policy for them to claim against.

The most important question I have though is: Did you report the accident to your insurance company in the first place?

If it was me I would grab lot's of ID and the insurance policy paperwork and be knocking on the door of the AXA office on the Meridian Business Park.

More importantly who did you take the insurance out with?

There is no way you did it yourself.

Glasgow and Edinburgh are some of the cheapest postcodes in the country to insure cars and used by fraudsters who set up policies for other people then pocket the cash they are paid whilst using other peoples credit card details.

It's got dodgy written all over it this one.

You cant blame the management company because as far as they are concerned your claim is fraudulent, now its upto you to contact axa and beg them to take up your claim, if they dont then you need to report it to the ombudsman

Why was you surprised... ?

How many times have you used a claims management company to know this was not a standard part of their procedures??

Just curious myself..

other than the excess thing (which only comes into play if they cant recover from the third party) - i dont understand why people are so afraid of telling their insurance and letting them deal with it. Its not like you can get away without telling them ever in this type of scenario.

You could have saved yourself all this hassle by contacting your insurance company direct instead of going through a claims company, this is why you pay insurance.
