Following an accident at work this evening where a drunk driver smashed into a colleagues car then drove off, my colleague was distressed that because the accident was on private land, insurance would be null and void.

As the public have unrestricted access to this private land, then do the rules of the road apply??

AFAIAA if the public have access to the land then all the RTA's are effective - happy to be proved wrong, but I can't see why the insurance co shouldn't investigate and (if neccc) pay up.

i think (from trolling the spl boards) that this is correct. for eg, if i have a prang in a petrol station, even though its private land, road rules apply as it has free access to the public. HTH

Used to be that under S.143 Road Traffic Act 1988 Insurance only applied to "road"

However Motor Vehicles (Compulsory Insurance) Regs 2000 added the following

"For the purpose of complying with the directives these Regulations amend the 1988 Act first by extending the insurance requirement to the use of vehicles in public places other than roads and, secondly, by making provision for the reporting of accidents and the production of insurance documents where an accident occurs in a public place."

Not sure if this helps as you say hit and run. Did they catch the driver or are you worried own Insurance won't pay up. If the later they have to unless your a 4 x 4'er and policy may make provisions about going off road.

Thanks for the replies, the incident happened on a petrol station as mentioned above. The CCTV system shows the incident well and there were various witnesses. My colleague was just worried that as the accident was on private land and a hit and run she would have to foot the bill.

Cant see a problem for your friend,just shite loads for the hit and run driver
