He's now phoning me up accusing me of "hacking" into his computer etc I am right in that no offence has been committed by simply changing the image on my own server?

That's my car!
As he's hotlinking the images, stealing my bandwidth, the question is, what shall I change the image to?

of course you're right - it's YOUR image, and you are not in contract with him to use that image - how could you possibly know someone had been using it illicitly?
Seriously - just laugh at him and tell him that next time he should go and actually photograph what he's selling - cheeky litle git!
Seconded Night!
The image is on your server, you have never accessed his PC (I presume) it appears he is hot-linking, not copying in any case, otherwise the pix would still be the car.
On another note I notice that your profile says 17K miles, so does the one in the advert, I hope he is not trying to sell your car........

It's a co-incidence, but the advert says a 2003 model, mine is the 2002 one.
That's NOTHING
I have seen someone steal another persons Ebay ID and item for sale, and he was selling a rare American car.
The guy that stole the ID managed to get several thousand pounds out of a potential buyer as a deposit on a car, that he didn't own
The guy that hid his Ebay ID and ad stolen, had to get a new ID, and place a warning Auction next to the original for sale item.
