Split up with GF but my car in her name on V5
Discussion
Hello
I have split up with my Girlfriend. My car that I paid for and drive around is registered in her name because it is insured i her name. She says I owe her money - right whatever. Now she says she wants the car back. I have the V5 and keys etc but it is in her name so do I need to return it?

If you have possession of the car, then "legally" you need to notify them that you are responsible for the vehicle.Return the V5 with your details completed and where the previous keeper should sign, say not present in this part, therefore you can't be seen as trying to sign her signature etc, but again remember its a legal responsibility to keep DVLA informed who is responsible for the vehicle!!
. Which is you, being in possession of it.If you can show you purchased the vehicle with your own funds, you have a strong case, make sure you find the receipt and have statement to hand. It's a civil dispute in any case.
You should however get your own insurance in place, as you will be changing the fundamentals of her policy and she could cancel her policy at any time, so don't leave yourself open to finding out the hard way, your not insured.

Is it still insured in her name?? If so, you need to get that changed ASAP, as i'm not sure where you stand if she is the main policy holder and you have an accident and need her authority to make a claim.
(I'm surprised no-one has picked up on the 'fronting' issue)
FWIW in future, as mentioned above, you can have yourself as the keeper, with your partner as the main driver. Just let the insurers know.

I was about to pick up on that, OP, why, if it is your car and you're the one driving it is the insurance in her name?(I'm surprised no-one has picked up on the 'fronting' issue)

I bought the car for her. But she didn't like it. I was the second driver on the insurance. She wouldn't let me sell her old car because she wanted to keep using it. So I spent a few quid on her old one. I have been using it for about 3 months. She has only driven it once.
Soa) it was a gift - therefore you're not the owner
b) you're the main driver, but not listed as such on the insurance and therefore fronting
Oh dear.

In the voice of Judge Judy.
The car was a gift sir.
You gave her the car, and now you have split up you want it back. The world doesn't work like that.
You could ask her for the car, and if she's a nice girl she might give it to you or sell it to you, but that's up to her not me.
You might say it wasn't a gift, but then we'll be asking about the legality of fronting and insurance fraud and we don't want to have that discussion do we young man.
Consider this a life lesson and move on, be more careful about giving expensive gifts in the future.
Just be thankful that it's just a car and that you don't have a child between you.
