looking for some advice, hope you can help

got my summons teh other day, 85 in a 50mph.

one page says you are hereby summoned to appear before the mags on 11th Nov

next page is a blue notice of plea and i says that i can fill in part A which is a notice of written plea of guilty (not coming to court). Filling in part B = plea of guilty and coming to court and part C = not guilty plea.

does this mean that I dont have to turn up. It says that i can bring the courts attention to some mitigating circumstances which i can list overleaf. Thing is my job will be untenable if im banned so i guess my question is, if i dont havr to rtun up, should i turn up anyway to ensure a better chance of swaying the mags to giving me a fine and no ban ?


what i dont understand is why they have given me the option of not attending. i thought you always had to attend court when getting banned so that they could take your license away ?

Hiya Jackal...

By the sounds of it..you've been offered..either

1) Plead guilty by post...

2) Plead not-guilty and either attend and fight your case, or attend and give mitigating circumstances.

P.S you cant be disqualified if your not at court,although this would only mean another summons,but it gives you more time

Looks like they might not be considering a disqualification...

hmm, can you or cant you be disqualified ?

can anyoen confirm this

i wouldnt want to not go if i knew i could affect my chances of not getting a ban if i turned up

You can be disqualified in your absence!

Part A = You plead guilty, do not turn up and they will deal with you and let you know the result/conviction and penalty by post.

Part B = You plead guilty and want to turn up to give mitigating circumstances.

Part C = You plead not guilty. You should not have to turn up. They will deal with it and just send you a new court date(trial date) in the post.
(It should explain this on the form)

Just had this myself on a different matter. Got sent a new mag court form saying "adjourned due to lack of court time, new date of hearing --/--/--," do not need to attend this either as they are still dealing with the first form.

To escape a ban you can plead that this will cause hardship through loss of job leading to loss of house, wife etc. etc. I would suggest that if you want to go down this road then it would be better to appear before the Beaks to plead your case supported by letter from your employer etc etc, rather than a note of a bit of paper.

If you want to minimise your penalty, go to court and say "I will never exceed the speed limit again. It is so wrong and I could have killed many children", they love to hear that carp
