if you believe you are about to be car-jacked ??

If someone hits your car from behind, and you suspect this is an attempt to steal your car, what can / should you do with regard to stopping and exchanging details etc ??? Are there allowances in the law ??

Drive to the nearest police station. If they are serious about sorting it out, they will follow you.

Failint that unless there are injuries you dont have to report it for up to 24 hours, only after then it becomes an offense.

I think thats it anyway... BiB?

Or a petrol station or somewhere there is CCTV.

No that is not right.

The law says
1. you must stop
2. you must provide details of driver name and address/owner name and address/insurance (even if damage only) to ANY PERSON who reasonable requires it. That may be someone not connected at all with the incident in a physical way. It could be a neighbour if damage is done to a property or the cousin of the other party involved if that person is not available at the time.

You have to give your name but the name and address of your solicitor is held to be complying with the law in replace of your own address.

3. If you do not commply with ANY of the above points OR SOMEONE IS INJURED you

MUST report the incident AS SOON AS IS REASONABLY PRACTICABLE AND IN ANY CASE WITHIN 24 HOURS

This means that you cannot report it when you feel like it. If you drive past a Police station or a Police officer, you must report the accident then, not drive home 200 miles and report it the following day because it was more convenient to do so!

Sorry, but I would not rely on the CCTV in any of these places to be either working or of quality sufficent to prosecute. The working practices of these places are below what you might expect.

If my own experience is anything to go by, it seems to be the case that if you have driven into someone (either on purpose or through stupidity or aggression), you may ignore the person trying to get you to stop (even when he catches up with you) and you will be let off by the police (even when the other person puts in a full report), presumably because they can't be bothered to investigate but "after much thought" (so said the words in the letter).

What to do when that happens and you're the "other person"?

If you've got a nice enough car that you feel someone may hijack it, then install a tracking device and give them the keys.....

Although guess who'd get punished if some scum got bitten by him whilst jacking the car

Good point. I know where 3 are where I live. 1 is closed, another has nowhere near to park your car so you'd probably get clamped for parking in permit only or on yellow line. Anywhere else, I've no idea. If in London I'd probably take a wrong turn and end up with a fine for entering congestion charge zone or driving in a bus lane or something.

In an attempt to escape a guy from the car in front of attacking me I reversed but unfortuneatly bumped a car behind. drove off still frightened and rang the police within 5 minutes reported to the police station. But am going to court 22/11 to face charges of failing to stop at an accident! So don't be confident the police will view this as sufficent (reporting the accident not stopping at the scene)Because the people in the car behind me have got £ signs for brains they claimed they were injured - all from a bump with no damage. Excuse me if I sound bitter but the police have let me down big time, I reported the threatening behavour in June but they couldn't be arsed to interview him until October!
