A guy ran a red light this evening and crashed into me, Tried to say the light was green , I was turning right into on coming traffic, i turned when the lights went solid amber at this moment the other car was a fair distance behind the lights and appeared to speed up to try and make it, however they didn't and ran the red light and clipped the back of my car, a chap came running over and said they saw him go thought the red light and gave me his details, so i have witness that lives around the corner from where it happened.

I am concerned with the guy claiming the light was green. what are the chances of it going 50/50 when you have an eye witness that lives literally round the corner from where it happened so is clearly not somebody i know.

You have an independant witness. Why is this even a thread?

Because anybody could say there mate is a witness, i was just wondering how much weight a witness carries, is it enough that you don't have to worry about the other party disputing it?

Indeed it can be most useful. Well worthwhile IMO.

Trying to think about this, and not sure if it will go 100% in your favour. I can't imagine the situation where I was waiting to turn right where I would actually make the move with a guy coming the other way if I wasn't convinced from his "body language" that he was going to stop; and the fact you thought he was accelerating implies you knew he was going to try to jump the lights frown

Had something similar though there was no accident I wondered what would have happened if the tool who ran the red had crashed into us.

You could tell though by the look on his and his wife's face plus the horn blasts that he was completely unaware of the red light he'd sailed through. The mitigation on his part as I saw it was the lights were close to buildings and possibly genuinely missed, then not too far through is a pelican which was green.

Had a txt msg from what seems to be his insurance this afternoon

pretty much says the following.

dear me

we are contacting you in regard to the incident involving our policy holder on the .... as it appears our policy holder appears to be at fault at this time we are offering to repair your car and give you a 3yr body work warranty and courtesy car. blah blah blah

I only contacted my insurance this morning as they were closed over the weekend, kind of sounds to me likes hes already admitted being at fault would his insurance send such a msg if that wasn't the case?

That sounds like a result smile

Remember that you have the right to send the car to the repair centre of your choice and don't have to accept their 'approved' repairer who will work to minimise cost. Often they will say that that invalidates the hire car but in a non-fault accident this shouldn't be the case as you can always threaten an AMC

Need to speak to my insurance again see if they have had contact from his, they hadn't as of this morning when i called them, sounds promising anyway, i think the police presence and ambulance that came to check up on my passenger scared him into not lying.

I was always under the impression that as you're turning right (and there's no filter light), you need to give way to oncoming traffic, even if they have gone/going to go through a red light.

I drive for a living and at least once a day I have to wait for some prat going through a red in these situations, which then leaves me stranded in the middle of the junction. Nine out of ten times it's a bloody taxi.

The junction in question has 3 lanes of on coming traffic so it takes aa litlle while to even get across, as the lights turned amber, i could see all the other cars slowing down, the one in the lane furthest from me was the one who hit me and they were quite a distance behind not such a distance that if they lights were green i could have made it but a distance that if you see the lights turning amber you have plenty of time to stop and not stopping at such a distance is quire frankly riddicouls no way on earth did i expect them to just keep going and jump the red, i see people jump red lights quite often and these people that "just about miss it" you can see a mile off this person however was a different story. Anway my insurance have now confirmed they have accepted full liability so can sleep well this Christmas after all, and the god awful corsa they have given me is being swapped for a like for like vehicle now liability is not in dispute, looks like i might have to take the corsa out tonight though only got it this morning and not driven it yet. They are trying to arrange something else today though so lets hope and see.
