My boyfriend was found guilty of speeding - 96 in a 30 - and has received a letter saying the case has been adjourned (he sent the paperwork by post originally)as the court is proposing to disqualify him and that he must attend the new hearing.

Please can someone let me know what the difference is between a ban and disqualification?

There is no difference. Your boyfriend will be disqualified which means that he is banned!
They are the same thing.

96 in a 70 = possible Ban (IIRC)

Anything lower than that is a very large ban. What the hell made him do that?

So if they are the same, will he have to retake his driving test to get his licence back??

muppet. sorry, but that is definitely one of the few examples where plod are right to prosecute a speeding driver.

that really is taking the piss, at that speed, it really would kill – no question about that.

I am not condoning the speed and do not wish to start a debate on speeds, but would point out that it was an empty road with no traffic/pedestrians and that visability and weather conditions were excellent. He also has a clean licence, over 20 years driving experience, including many miles driving as an IT contractor. Like I said, I do not approve of what happened but I think its only fair to set the full scene after the previous comment.

From a lawyer's point of view, he is seriously going to have get some representation.

He could be looking at a prison sentence, assuming that the speed quoted is not a typo.

He may weel get a short ban.

Mags discretio whether to enforce a test retake.

Are you referring to 96 in a 30 (misprint) or 96 in a 60 ? If you are referring to the latter (which is still 36 mph over, agreed) then your comments are a bit harsh bearing in mind you are unaware of the circumstances of the incident, the road and conditions at the time he was caught.

96 in a 30 would be feckin' crazy. But 96 in a 60 (which is not a built up area) ? Mmm, a whole world away from 66mph over in suburbia, IMO.

Thanks - the original post was a typo - it was 96 in a 60. Still a huge problem? You don't have an email address in your profile....

Shouldnt be so bad then

Friend of mine got done for 90 in a 50 a while back. he got 6 points and a £500 fine.

Likely to be 6 points and a fine then.

But (and this is cheesy obvious stuff) make SURE he wears a suit and say he is very sorry.

Such humble pie will save his licence. Just.

If it was a 60, that’s not so bad - there are a lot of roads I know where you *could* do that fine, no turnings etc just straight (but single carriage way) road.

As a fellow driver, I wish him luck and hope nothing too bad happens – hopefully he wouldn’t do anything like that again.

I hardly think that you are in a position to comment, maybe when you have some significant experience of driving sports cars we can have this discussion again.
