Help on being flashed

Hi

OK there's this one gatso near my girlfriends house just by the bp garage next to the corn exchange (think its lanark rd edinburgh) anyway I know it's there and active so i always slow when i pass it. However, tonight some twat set it off going the other way and of course my car will be in both pictures as if it was mine that set it off. Now i am very worried, as i have heard of stories that they just issue nips without assessing the photo properly, and i fear i might get one when i wasnt speeding. secondly, i was doing 31 in a 30, if the burden of proof falls on me to prove i wasnt speeding and i work out that im doing 31 which is over the limit, will i be prosecuted or is there some sort of give and take? help needed please. i cant afford an insurance hike if i get points when i dont deserve them. cheers.

im sure the photo's should display the speed of the offending car,iirc the way its shown is if it was you then it would say +xx mph,if its the other bloke then it'll be -xx mph.

im sure one of the p.h collective will give you a definate answer though.

Cars going the opposite direction will usually set off one flash, not two. (AFAIK)

relax, you're not going to get points!!

even if they did decide to send a NIP, simply ask for the photos - the markings up the road will show you to be in the clear.

btw, 31mph on your speedo is probably about 28mph in real life, so I really wouldn't worry!

Hiya Andy,
the camera needs to be calibrated properly if it's being set off by vehicles on the other side of the road travelling in the opposite direction.
Despite what the Fiscal regularly tries on the burden of proof is absolutely and totally on the crown, you don't have to prove a thing; they have to prove, beyind all reasonable doubt, that you are guilty of an offence.
I would simply wait and see what happens and if you receive anything, you must request the photos and, most importantly, the test and maintenance schedule for that particular camera.

Happned to me this morningon the A40 going into London. Indicated 40 Limit 40, I can only guess it was the car in lane one that was progressing faster than me up the slip road.
Not worried about it, It's happned before and I never heard anything.

GATSO cameras set up to detect and flash oncoming traffic are usually dummies, radar and flash but no film. They used to flash once but now their set up is to flash twice like the loaded ones. Unliklely you'll hear anything more.

My hubby has just got back from golfing.....to say he was flashed by a camera. Thought he was in a 40m limit but is actually a 30m. He was oncoming to the camera with no lines on his side of the road. Also noticed that the camera has recently had a paint job, all silver.

Any thoughts from the GATSO experts?

You probs wont recieve anything but i know of one friend who did.

If it was a gatso, simply deny the offence by saying you werent speeding and could you please have the 2 photos to confirm this.

The road markings are there to provide a back up for this. I believe the phots are taken 1/2 or 1 second apart, the markings on the road are a set distance, (im not sure what they are though) so its easy to work out.
