legal question - Prostitution vs Pornography

yet another of my idle wonderings Im afraid....

According to the dear old Oxford English :

prostitute : a person, typically a woman, who engages in sexual activity for payment.

Now as I understand it, it isn't actually illegal to be a hooker...but it IS illegal to solicit for business. Is this correct? Also, when someone gets arrested for kerb crawling what precisely are they being done for?

Porn films - basically you get a load of people together and pay them all for having sex. Then you go and make lots of money out of selling said sexual film.

I believe that UK law now permits hardcore pornography sales and distribution (relevance; there can be no claim that 'they're justa acting')

So...my question....why can't you wander around and sell yourself for sex, yet apparently you CAN sell yourself for sex as long as it's in front of a camera?

First point is correct, its the solicitation thats illegal.

Pornography isnt solicitation though, so the two arent equal.

well quoting the OED again :

solicit : ask for or try to obtain (something) from somone

their actual example : "accost someone and offer one's or someone elses's services as a prostitute"

So...I assume the reason that soliciting is illegal is to a) stop pimps who may be running girls who DONT want to be hookers and b) stop 'morally decent upright blah bah' from getting accosted. but it all comes down to 'making money out of the enterprise'

I accept that porn and soliciting arent directly comparable, but its the underlying reason Im more interested in. Porn Barons make their money out of selling toher peoples sexual activity. Where's the 'real' difference?

Its a good question though I have to say...

With a prostitue the punter pays the prostitute for carnal services rendered.

With a porn shoot a third party pays both people for the right to film them.

Thats the core difference I think...

yeah - think you're likely right there....as a detail point in law that makes a good excuse, but as an underlying 'selling yourself for sex is bad' (which is definitely the impression given by outlawing prostitution) its kinda a mixed message!

Shirley if you are in a porn film you are a prostitute as you are having sex for money. If you then attempt to seek that work you are soliciting?

So it is legal to be a porn star as long as you don't tell anyone in order to get work? Which presumably means that they can't release the film as that is effectively advertising your services and the distibutor could therefore also be considered to be soliciting?

That's why you should always find one that takes VISA. Though I appreciate that this is tricky as some girls are not clearly marked. It also provides useful consumer protection as if you later find your orgasm to be defective you can always seek redress from the card issuer
