So back in April I parked over in a McDonalds car park off Billingsgate it was 18 minutes over, I basically had a breakfast and a brew then took 40 winks. I thought without even looking at the notices that I was allowed 2 hrs .

Anyway along comes a PCN from MET services asking for £50 if paid in 7 days or £100 after that. I wrote them a letter via a template I got off Parkingprankster.co.uk and as predicted they denied my appeal so I appealed to POPLA and based my appeal on actual loss as opposed to the silly £100 arbitrary amount .

Today I received an e-mail from POPLA saying my appeal had been allowed, but the reasons the had allowed it were for non of the reasons I had appealed, it looked as though MET services made no attempt to defend the charge or present any evidence.

So happy non the less and I think it goes to show the effectiveness of these charges if you fight and challenge them is negligible .

Which is precisely why these things should go straight in the bin - they won't even turn up to pursue ones where you have effectively admitted guilt of one sort or another, let alone where you simply don't respond to them.

that's cos they don't want to lose. Plus it might actually take some effort on their part. Well done.

I have done both, assigned them to the bin and appealed...when a Parking eye one went in the bin never heard another thing but when a MET one went in the bin it took me ages to extricate myself from it. So the appeal thing is for me from now on.!

Simpler solution in Asda, take it to customer services. No deal - write to local paper,advising that no discretion is shown. I can guarantee that next week some PR person from local Asda will advise taking ticket in to have it rescinded. I've had two from Asda, one pre the deal date, which I binned and after a couple of letters T & C "forgot2, and one lately, showing me entering in the morning, but no exit photo, no re entry photo going back in the afternoon ,some five hours later . I took it to customer services, to be told it would be voided. It wasn't, so the next one was similarly treated, with a copy to on line customer services advising that any further letters would get local press coverage claiming that their ANPR system was faulty and their parking company were not checking the data/maintaining the system. NO FURTHER PROBLEMS. POPLA costs them about £30 per appeal, but they don't like bad publicity. That costs them a lot more.

Why take the risk when a POPLA win stops them dead in their tracks? It also hits the their bottom line.
The politicians were royally conned by the private parking industry into not creating a statutory appeal body like PATAS and TPT.

Why not both? biggrin The annoying thing is that some people will just pay up to avoid hassle, or thinking they can't win. Some publicity will help this.

I have sympathy with supermarkets and other places with a lack of parking (or abuse by people not entitled to park there), the anger should be directed at councils and then central government who make it difficult for companies to put in adequate parking provision for their customers and employees.

Gareth -WHY. I come from a generation where before cars. I could go to a shop and place a large grocery order and be asked when I would like it delivered ,and delivery would be free. Up to recently ,we had an old fashioned store ( Sainsbury) ,which has a car park next to a park( and a crap pond which stinks next door). I used to park in the car park, take my dog for a walk in the park and shop in store. I thought it a bargain- I park for free- store gets my custom. Then store brought in a parking firm ,with free parking for a set time,and instore prices rose. So- I parked, got a free ticket, and shopped elsewhere where prices were lower. I discovered later that the parking attendants at JS were told not to be aggressive, as it drove customers away . I did have a conversation with parking lady on the topic of tickets prior to the backslide by Cameroon, and told her that they could send them out, but the tickets had no legal status.

I used to work at a Marks and Spencer store where customers could collect their shopping from the loading bay round the back. Of course the traffic wardens used to swarm around there looking for people who stopped slightly on the footpath or on the double yellow lines if they couldn't get onto the loading bay. One day the lorry driver who was delivering stopped his lorry overhanging the end of the loading bay while we moved some trollies so he could reverse in. At the same time some customers were queuing in their cars to collect their shopping. The traffic wardens booked the lorry driver and several customers who were sitting in their cars not even parked. Some ops staff came out and persuaded them to cancel some tickets, they may say they can't cancel an issued ticket but several well built chaps can make them find a way to.

One old lady with a husband who has Alzheimers just paid her parking fine even though I told her to appeal it on the grounds that she was queuing in traffic and not even parked at the time, which was true, but she just paid up because she didn't want the hassle.

I repeatedly tried to make my manager complain to the council about the parking issue, he was always having tea and biscuit meetings with council bigwigs about town centre shopping issues and the major thing killing the town centre is the bloody traffic wardens, but he was too much of a wimp to.

Yup but their priorities are sometimes different in an attempt to prevent 'gridlock' and encourage people to us alternative means ?
Although i always used to drive "they" have made it easier, quicker and cheaper generally for me to get into & around Manchester (centre) by train & free bus than driving

After talking to a few people about parking layouts and being miffed at how one near me was being set out i now understand why they set it out in a certain way ,and how properly thought/set out a certain way for traffic flow and management purposes they meet the needs of the greater "through" traffic rather than the developers needs.

What risk.
On the occasions I have spoken with them I have said I will see them in court and "You will have to prove that I lost the company you are representing money by using that space. I will prove in court just how much I spent when parking there.'
Never hear anything else.

Are you aware the law changed recently and they can now sue the registered keeper for breach of contract, regardless of whether he was driving?

Before the change, they had to determine the identity of the driver, which was nigh on impossible.

They have to prove you have lost the company they are representing income though.
If you have spent money with said company they will leave you alone as they know this too.

Maybe this has changed too?

I haven't had any for a year or so.
